The EELF is a non-profit initiative of environmental law scholars and practitioners from across Europe aiming to support intellectual exchange on the development and implementation of international, European and national environmental law in Europe. One of the activities of the EELF is an annual conference. This book is comprised of fifteen contributions presented at the Third EELF Conference in Aix-en-Provence, hosted by the Central European Research Infrastructure Consortium, at Aix-Marseille University, September 2015. The central topic of the book is the effectiveness of environmental law. The impressive development in environmental law has not always been matched by corresponding improvements in environmental quality. The threats to our environment and, by extension, to our health have never been so numerous or serious. But paradoxically, the effectiveness of environmental law has been a long-neglected issue. The situation of extreme poverty experienced by the majority of the populations in developing countries ("Third World" countries) often coincides with an absence of democracy and the violation of the most fundamental rights. But in so-called "First World" countries a non-negligible proportion of inhabitants also live in impoverished conditions (albeit mainly "relative" poverty) and are denied their rights. The European situation, which this publication aims to analyse, is painful: the entire continent is afflicted by increasing poverty and consequently by the erosion of living conditions and social conflicts.The economic and financial crisis has resulted in the loss of millions of jobs, and created job insecurity for many still working. Economic insecurity raises social tensions, aggravating xenophobia, for instance. Yet the economic and financial crisis could present a good opportunity to rethink the economic and social system as a whole. Indeed, poverty in modern societies has never been purely a question of lack of wealth. It is therefore urgent today to devise a new discourse on poverty. In pursuit of this goal, the Council of Europe is following up this publication in the framework of the project "Human rights of people experiencing poverty", co-financed by the European Commission.

These include: how consent to arbitrate is expressed and when mutual consent to arbitration is reached; which law shall govern the arbitration agreement or, more particularly, consent as an element of the substantive validity of it; and, conversely, according to which law will a possible lack of consent be judged; how consent should be interpreted; which relationship exists between consent as part of the substantive validity of an arbitration agreement and its formal validity; which, if any, are the implied terms when consenting to arbitration; how consent to arbitrate influences procedural aspects (counterclaims, joinder, consolidation), and which solutions adopted by treaties, national laws or arbitration rules are, or would be, the most respectful of parties' consent in this respect; what in investment arbitration is the relationship between consent and most-favoured-nation clauses or the influence of umbrella clauses. The book includes original arguments and puts forward new suggestions with regard to the changeable consensual character of arbitration. Problems vary from water scarcity and a degrading water quality, to floods and a rising sea level due to climate change. The European Union adopted a Water Framework Directive to improve the sustainability of water management in its member states. Water management should be coordinated at the level of river basins as a whole. Interests of various user groups should be better represented. River basin visions should take into account the impact of all human activities on the status of the resource. Water legislation needs streamlining and more focus on its implementation. The European Union advocates regulating water prices by charging the costs of water services on the basis of full cost recovery and the polluter pays principle. This book examines the development of water management in the Netherlands, Belgium, France, Spain, Italy and Switzerland. It is based on the European research project EUWARENESS. The authors apply a theoretical framework for the analysis of institutional regimes, water governance and property rights. The evolution of national water resource regimes is described over a period of almost 200 years (1800-2000). Filiation is a multifaceted concept in Muslim jurisdictions. Beyond its legal aspect, it encompasses the notion of inclusion and belonging, thereby holding significant social implications. Being the child of someone, carrying one’s father’s name, and inheriting from both parents form important pillars of personal identity. This volume explores filiation (nasab) and alternative forms of a full parent-child relationship in Muslim jurisdictions. Eleven country reports ranging from Morocco to Malaysia examine how maternal and paternal filiation is established – be it by operation of the law, by the parties’ exercise of autonomy, such as acknowledgement, or by scientific means, DNA testing in particular – and how lawmakers, courts, and society at large view and treat children who fall outside those legal structures, especially children born out of wedlock or under dubious circumstances. In a second step, alternative care schemes in place for the protection of parentless children are examined and their potential to recreate a legal parent-child relationship is discussed. In addition to the countr y-specific analyses included in this book, three further contributions explore the subject matter from perspectives of premodern Sunni legal doctrine, premodern Shiite legal doctrine and the private international law regimes of contemporary Arab countries. Finally, a comparative analysis of the themes explored is presented in the synopsis at the end of this volume. The book is aimed at scholars in the fields of Muslim family law and comparative family law and is of high practical relevance to legal practitioners working in the area of international child law.
