Incluso en los derechos ya reconocidos, su ejercicio no está exento de polémicas y coacciones, tanto a quienes quieren ejercerlos como al personal médico. Algunos casos individuales de personas que han luchado hasta su último suspiro por el derecho a morir con dignidad y la libertad de elegir su final, mantienen vivo un debate que debemos afrontar sin miedo, sin prejuicios, sin servidumbres morales o religiosas.

Book excerpt: Producto de la ruta metodológica trazada y recorrida, el presente documento sistematiza nueve lineamientos técnicos los cuales permitirán garantizar el derecho a la muerte digna, a la capacidad jurídica y volver operativo el principio de la mejor interpretación de la voluntad y de las preferencias de las personas en casos en que las personas no pueden manifestar su voluntad y no lo hicieron anticipadamente. Los lineamientos abordan: (1) el significado de hacer la mejor interpretación de la voluntad y las preferencias de la persona; (2) la necesidad de evaluar la imposibilidad de manifestar la voluntad por parte de la persona en nombre de quien se hace la solicitud; (3) la composición de la red de apoyo; (4) el abordaje y descarte de los conflictos de intereses; (5) verificar que se hubieran ofrecido los cuidados paliativos y la adecuación del esfuerzo terapéutico; (6) el rol que pueden jugar tanto la historia clínica como las conversaciones previas con profesionales asistenciales; (7) la evaluación del sufrimiento en clave de la experiencia vital de la persona; (8) construir la narrativa de vida y la mejor interpretación de la voluntad a través de las entrevistas a los miembros de la red de apoyo y; (9) el consenso necesario en la interpretación de la voluntad y las preferencias.

Es poco tomada en cuenta en la legislación mexicana así como en el mundo, siendo de suma importancia concientizar sobre este tema, a lo cual considero que de ser legalizada se evitarían sufrimientos innecesarios en personas con enfermedad terminal o casos similares.Ahora bien, tomemos en consideración los derechos de la esfera personal como lo son el derecho a la integridad física y moral del individuo, así como a la dignidad humana, si bien es cierto el derecho a la vida se encuentra protegido constitucionalmente y no permite el darle fin por decisión propia, pero si lo analizamos desde la integridad física y moral puede ser admisible de alguna manera, debido a que todos los seres humanos tenemos derecho a una muerte digna.Finalmente, he llegado a la conclusión de que al pretender una muerte digna, se intenta que la muerte asistida sea analizada desde los derechos fundamentales del individuo principalmente la dignidad, que en mi punto de vista es el eje central de los derechos fundamentales, ya que es un valor intrínseco del ser humano, además tenemos que reflexionar que en efecto la vida es un derecho y tan lícita es mantenerla como decidir darle fin, porque una vida sin dignidad no es vida.

First, it synthesizes and describes the emergence of the right to die with dignity in Colombia, analyzing how it was born, how it has evolved, and how it has been consolidated in recent decades, proposing a genealogy of the process that allows us to understand and communicate it. Second, it reflects on the law as an instrument of social change: it uses the path of the emergence and evolution of the right to die with dignity as a successful case—despite its difficulties and limitations. These two objectives are developed in the first chapter. Third, the publication examines Colombia's current state of the right to die with dignity. It explains its legal nature and core obligations and discusses the mechanisms available to exercise it and the criteria that must be met to access them. The second chapter develops this objective. Finally, in the conclusion of the text, it identifies the challenges that we will face in the future, not only in Colombia but also in Latin America, when it comes to the right to die with dignity, that is, the recognition, expansion, and deepening of the possibility of making free and autonomous decisions about the end of life.
