Book excerpt: En este trabajo de fin de máster, se pretende exponer que se entiende por modificaciones sustanciales de las condiciones de trabajo y cuales han sido las novedades introducidas por la reforma laboral. La MSCT se puede definir como la facultad que tiene el empresario de modificar unilateralmente las condiciones de trabajo de sus empleados, que estén por encima de las previstas en convenio colectivo. Con tal finalidad, el art. 41 del Estatuto de los Trabajadores, establece un importante listado de materias modificables por el empresario, entre las que se encuentran la jornada, horario de trabajo y salario. Sin ser esta en todo momento una lista cerrada, sino que permite la inclusión de todas aquellas condiciones que se sitúen por encima de lo establecido en el convenio colectivo.No obstante, para evitar que se produzca un abuso por parte del empresario, dicho artículo prevé la imposibilidad de aplicar la modificación sustancial de las condiciones de trabajo sin la existencia, de causas empresariales (económicas, técnicas, organizativas o de producción) y sin realizar un concreto procedimiento, bien sea individual o colectivo en función del número de trabajadores.Con el RD 3/2012, de 10 de febrero, de medidas urgentes para la reforma del mercado laboral ratificado por la Ley 3/2012 de 6 de julio, de medidas urgentes, se producen una serie de alteraciones en instituciones básicas del Derecho del trabajo entre las que se hayan las modificaciones sustanciales de las condiciones de trabajo.Esta última reforma pretende que se opte por ciertas medidas menos traumáticas que la extinción contractual. Así pues, se consigue con ella el ajuste de las relaciones de trabajo evitando que aumente la tasa de desempleo. Con lo que los arts. 40 y 41 del ET se han vuelto a diseñar dando lugar "a una nueva redacción clara y diáfana a la hora de indicar que puede hacer el empleador y cómo lo puede hacer, así como las posibles reacciones del trabajador ante estas decisiones empresariales de modificaciones sustanciales de las condiciones de trabajo".Este va a ser el principal objetivo de este trabajo, dar a conocer como intervienen las modificaciones sustanciales de las condiciones de trabajo respecto a los trabajadores y como han cambiado a lo largo de las reformas la forma de interpretarlas.

She argues that while Mexican workers do not necessarily constitute cheap labour for Canadian growers, they are vital for the survival of some agricultural sectors because they are always available for work, even on holidays and weekends, or when exhausted, sick, or injured. Basok exposes the mechanisms that make Mexican seasonal workers unfree and shows that the workers' virtual inability to refuse the employer's demand for their labour is related not only to economic need but to the rigid control exercised by the Mexican Ministry of Labour and Social Planning and Canadian growers over workers' participation in the Canadian guest worker program, as well as the paternalistic relationship between the Mexican harvesters and their Canadian employers.
