Il testo dimostra la necessità di un grande sforzo culturale che affianchi i tanti interventi formativi già presenti nelle scuole per dare agli stessi organicità, sistematicità e capillarità e per proporre attività divulgative intorno ad un progetto, un’“infrastruttura organizzativa di servizio” per una rete di cittadini, cittadine, mediatori, professionisti, formatori, dirigenti scolastici, insegnanti, personale non docente, studentesse e studenti. Fino alla proposta di una rete che immagina come si possa davvero concorrere a disseminare oggi una sensibilità per raccogliere dei comportamenti non conflittuali domani.

Al d. lgs. 28/2010, con il quale il legislatore ha introdotto - sulla scorta dell’esperienza straniera e delle indicazioni dell’Unione europea - una innovativa forma di alternative dispute resolution (ADR) tesa a ridurre il numero delle controversie su diritti disponibili sottoposte o da sottoporre per la decisione alla Autorità giudiziaria ordinaria, ha infatti fatto seguito il D.M. 18 ottobre 2010, n. 180, recante regolamento sui criteri e modalità di iscrizione e tenuta del registro degli organismi di mediazione e dell’elenco dei formatori (e anch’esso oggetto di commento esegetico in questa seconda edizione). Pur nel rispetto del rigore scientifico, l’opera resta caratterizzata anche da un taglio pratico in considerazione della straordinaria importanza concreta che la disciplina presenta e che, dopo l’estensione del procedimento obbligatorio di mediazione anche alle residue materie contemplate nell’art. 5, si è accresciuta notevolmente.
