Book excerpt: La référence à la " loi du pays d'origine " est apparue dans le contexte des libertés européennes de circulation et, avec elle, l'affirmation selon laquelle les personnes, les biens et les services pourraient circuler au sein des États membres aux seules conditions de leur " loi d'origine ". Pourtant, cette affirmation ne résiste pas à l'analyse. D'une part, il est difficile d'identifier concrètement à quoi renvoie cette " loi ". D'autre part, malgré une formulation faussement évocatrice d'un mécanisme de conflit de lois, ladite " loi " n'est pas directement appliquée. En revanche, le droit de l'Union contient diverses techniques portant une attention particulière au système juridique de l'État d'origine des titulaires des libertés de circulation, que l'on peut regrouper au sein d'un concept d'origine. La " reconnaissance mutuelle ", la règle du " home country contrôle " et le " principe du pays d'origine" sont les principales déclinaisons de ce concept. L'analyse sous l'angle du droit international privé permet de mettre en lumière de réelles interférences normatives et méthodologiques entre les expressions du concept d'origine et cette matière. Ainsi, l'intervention de certaines expressions de ce concept peut être source de tensions avec les règles du droit international privé. En outre, leur mise en oeuvre technique se réalise à la manière tantôt d'une technique de conflit de lois lato sensu, tantôt d'un procédé de reconnaissance au sens du droit international privé. Dans ce contexte, on peut dès lors se demander si, de lege ferenda, le concept d'origine ne pourrait pas être la matrice de nouvelles techniques de droit international privé de l'Union. Book excerpt: The Violence of Modernity turns to Charles Baudelaire, one of the most canonical figures of literary modernism, in order to reclaim an aesthetic legacy for ethical inquiry and historical critique. Works of modern literature are commonly theorized as symptomatic responses to the trauma of history. In a climate that tends to privilege crisis over critique, Debarati Sanyal argues that it is urgent to rethink literary experience in terms that recall its contestatory potential. Examining Baudelaire's poems afresh, she shifts the focus of critical attention toward an account of modernism as an active engagement with violence, specifically the violence of history in nineteenth-century France. Sanyal analyzes a literary current that uses the traditional hallmarks of modernism—irony, intertextuality, self-reflexivity, and formalism—to challenge the historical violence of modernity. Baudelaire and the committed ironists writing in his wake teach us how to read and resist the violence of history, and thereby to challenge the melancholy tenor of our contemporary "wound culture." In a series of provocative readings, Sanyal presents Baudelaire's poetry as an aesthetic form that contests historical violence through rhetorical strategies of complicity, counterviolence, and critique. The book develops a new account of Baudelaire's significance as a modernist by dislodging him both from his traditional status as a practitioner of "art for art's sake" and from his more recent incarnation as the poet of trauma. Following her extended analysis of Baudelaire's poetry, Sanyal in later chapters considers a number of authors influenced by his strategies—including Rachilde, Virginie Despentes, Albert Camus, and Jean-Paul Sartre—to examine the relevance of their interventions for our current climate of trauma and terror. The result is a study that underscores how Baudelaire's legacy continues to energize literary engagements with the violence of modernity.

Book excerpt: Looking at decolonization in the conditional tense, this volume teases out the complex and uncertain ends of British and French empire in Africa during the period of ‘late colonial shift’ after 1945. Rather than view decolonization as an inevitable process, the contributors together explore the crucial historical moments in which change was negotiated, compromises were made, and debates were staged. Three core themes guide the analysis: development, contingency and entanglement. The chapters consider the ways in which decolonization was governed and moderated by concerns about development and profit. A complementary focus on contingency allows deeper consideration of how colonial powers planned for ‘colonial futures’, and how divergent voices greeted the end of empire. Thinking about entanglements likewise stresses both the connections that existed between the British and French empires in Africa, and those that endured beyond the formal transfer of power.

Its subject, reflected in the title "Sciences and Empires", is not a currently-accepted sub-discipline of the history of science; rather, it refers to a set of questions which found autonomy only recently. The terminology was strongly debated by the participants and, as is frequently suggested in this book, awaits fuller clarification.

Book excerpt: This volume consists of a carefully edited version of the General Course on Public International Law delivered at the Hague Academy of International Law to commemorate the fiftieth anniversary of the foundation of the United Nations. The author brings to them not only his background of academic distinction, but his experience as a practitioner concerned with major international legal issues. The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Recent successes of the Court include the effective resolution of the territorial dispute between Chad and Libya. The general level of compliance with its decisions by States is impressive. Yet its success is matched not by encouragement and enhancement of its facilities but by United Nations financial constraints which hinder its work and, ultimately, may threaten its independence in relation to the political organs of the United Nations.
