Book excerpt: On February 11, 1912, an estimated 120,000 people in Paris participated in a ceremony that was at once moving and macabre: a public procession to Père Lachaise Cemetery, where the remains of a soldier named Albert Aernoult would be incinerated after a series of angry speeches denouncing the circumstances of his death. This ceremony occurred at a pivotal point in the "Aernoult-Rousset Affair," a three-year agitation over the practice of French military justice that was labeled a "proletarian Dreyfus Affair." Aernoult had died in one of the French Army's Algerian penal camps in the summer of 1909, allegedly at the hands of his officers. His death came to the attention of the public through the intervention of a fellow prisoner, a career criminal named Émile Rousset, who provoked prosecution in a military court in order to launch his own J'accuse against camp officers. Rousset's charges seemed to be bearing fruit until he himself was indicted for murder, whereupon the entire Affair took on a new intensity. Cerullo's lively, suspenseful account of this dramatic story, which has never been fully told, will become the standard. In the current era of special military courts, commissions, and prisons, the subject of military justice is an urgent one. Minotaur will interest historians of modern France, military historians and students of military justice, and legal scholars, while also appealing to general readers of modern European history and military law.

She was also the greatest military power of antiquity, operating her military organization with remarkable efficiency and effectiveness throughout most of the then-known world. In view of the importance of both the legal and military aspects of the Roman Empire, an account of their combination in a system of disciplinary control for the Roman armies is of considerable significance to historians in both fields—and, in fact, to scholars in general. In Roman Military Law, C. E. Brand describes this system of control. Since a characterization of such a system can be made most meaningful only against a background of Roman constitutional government and in the light of ideologies current at the time, Brand follows his initial “Note on Sources” with a sketch of the contemporary Roman scene. This first section includes a discussion of the Roman constitution and an examination of Roman criminal law. The history of Rome, as a republic, principate, and empire, extended over a period of a thousand years, so any attempt to represent a generalized picture must be essentially a matter of extraction and condensation from the voluminous literature of the whole era. Nevertheless, from the fantastic evolution that is the history of Rome, Brand has been able to construct a more or less static historical mosaic that may be considered typically “Roman.” This comes into sharpest focus during the period of the Punic Wars, when the city and its people were most intensely Roman. The picture of the Roman armies is set into this basic framework, in chapters dealing with military organization, disciplinary organization, religion and discipline, and offenses and punishments. The final section of the book considers briefly the vast changes in Roman institutions that came about under the armies of the Empire, and then concludes with the Latin text and an English translation of the only known code of Roman military justice, promulgated sometime during the later Empire, preserved in Byzantine literature, and handed down to medieval times in Latin translations of Byzantine Greek law, which it has heretofore been confused.

Until recently, the history of military justice has been largely neglected. As a hybrid concept, it has for many years been the subject of hasty judgments from both military institutions and lawyers. Members of the military institutions kept repeating harsh criticisms while the lawyers kept justifying themselves. This volume brings together 20 contributions that focus on the early 20th century in Western Europe with the aim of examining the tensions, practices and limitations of military justice during the two World Wars. In doing so, it uses a methodological and original approach, from the perspective of transnational reality and uses case studies from a range of countries at different times. The contributions were all presented during multiple seminars held at the Maison des sciences de l’Homme between 2004 and 2008. Using a comparative perspective, these seminars explored the evolution of the military justice system since the 16th century.
