Book The Law of Automobiles Classic Reprint

Download or read book The Law of Automobiles Classic Reprint written by Xenophon P. Huddy and published by Forgotten Books. This book was released on 2018-02-19 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Automobiles Not only have the law-making bodies enacted laws in reference to the motor car and automobiling, but the reported judicial decisions of the highest courts of record and other courts in many jurisdictions are multiplying, and have accumulated to such an extent that many questions of vital importance have been decided. Very true, many of the cases merely have called for the application of established rules of law, in deal ing with the motor vehicle; but there have been decided numerous points of special application to the automobile and its operation on the public avenues of travel, of which the up-to-date layman, lawyer, and judge should be cognizant if he is to keep abreast with the progress of scientific inventions which are bound to figure in litigation and to occupy a prominent place in our jurisprudence. That there existed a necessity for a collection of all the law, both statutory and that announced by the courts in an accessible convenient form, is undoubted. The encouragement given to the author in his under taking to compile this work by gentlemen prominently interested in automobiling has strengthened his belief that a work of this kind will be welcomed. Book A Prelude to the Welfare State

Download or read book A Prelude to the Welfare State written by Price V. Fishback and published by University of Chicago Press. This book was released on 2007-11-01 with total page 331 pages. Available in PDF, EPUB and Kindle. Book excerpt: Workers' compensation was arguably the first widespread social insurance program in the United States and the most successful form of labor legislation to emerge from the early Progressive Movement. Adopted in most states between 1910 and 1920, workers' compensation laws have been paving seen as the way for social security, Medicare, unemployment insurance, and eventually the broad network of social welfare programs we have today. In this highly original and persuasive work, Price V. Fishback and Shawn Everett Kantor challenge widespread historical perceptions, arguing that, rather than being an early progressive victory, workers' compensation succeeded because all relevant parties—labor and management, insurance companies, lawyers, and legislators—benefited from the legislation. Thorough, rigorous, and convincing, A Prelude to the Welfare State: The Origins of Workers' Compensation is a major reappraisal of the causes and consequences of a movement that ultimately transformed the nature of social insurance and the American workplace.

Download or read book The Accidental Republic written by John Fabian Witt and published by Harvard University Press. This book was released on 2009-07-01 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the five decades after the Civil War, the United States witnessed a profusion of legal institutions designed to cope with the nation’s exceptionally acute industrial accident crisis. Jurists elaborated the common law of torts. Workingmen’s organizations founded a widespread system of cooperative insurance. Leading employers instituted welfare-capitalist accident relief funds. And social reformers advocated compulsory insurance such as workmen’s compensation. John Fabian Witt argues that experiments in accident law at the turn of the twentieth century arose out of competing views of the loose network of ideas and institutions that historians call the ideology of free labor. These experiments a century ago shaped twentieth- and twenty-first-century American accident law; they laid the foundations of the American administrative state; and they occasioned a still hotly contested legal transformation from the principles of free labor to the categories of insurance and risk. In this eclectic moment at the beginnings of the modern state, Witt describes American accident law as a contingent set of institutions that might plausibly have developed along a number of historical paths. In turn, he suggests, the making of American accident law is the story of the equally contingent remaking of our accidental republic.

Book Towards Consistency in International Investment Jurisprudence

Download or read book Towards Consistency in International Investment Jurisprudence written by Katharina Diel-Gligor and published by BRILL. This book was released on 2017-05-22 with total page 614 pages. Available in PDF, EPUB and Kindle. Book excerpt: Investor-State arbitration is currently a much-debated topic, both within the legal community and in the public at large. In Towards Consistency in International Investment Jurisprudence, Katharina Diel-Gligor addresses the alleged proliferation of inconsistent decision-making in this field – one of the main points of concern raised in the ongoing discussions. After exploring whether such criticism is appropriate at all, she goes on to examine the different causes, forms, and manifestations of the inconsistencies that exist through a detailed analysis of ICSID arbitration. The author then canvasses possible approaches to reform and concludes that an ICSID preliminary ruling system – the practicalities of which are set out in the study – is a suitable means for enhancing consistency in investment arbitration and moving towards a jurisprudence constante.
