Invero, la disciplina organica del paradigma riparativo è accompagnata dalla regolamentazione degli snodi procedurali e degli effetti giuridici che la restorative justice produce nell’interazione con il procedimento e con l’esecuzione penale: il rapporto di complementarità tra le due forme di giustizia costruito dalla recente riforma dischiude nuovi orizzonti e lancia nuove sfide. Il presente volume intende offrire tanto un’attenta e completa mappatura normativa delle novità introdotte dal d.lgs. n. 150/2022 (e dalle numerose fonti secondarie che si sono rese necessarie per la costruzione di un impianto radicalmente nuovo), quanto la bussola per orientarvisi, con l’obiettivo di fornire al giurista non solo la conoscenza degli strumenti normativi, ma anche la consapevolezza della diversa caratura culturale del paradigma riparativo: muniti di queste conoscenze e consapevolezze sarà possibile percorrere il ponte normativo che oggi mette in contatto i due territori di giustizia, evitando di incorrere in errori prospettici o pericolose commistioni osmotiche, per cogliere la preziosa opportunità di rispondere a bisogni di giustizia finora rimasti sostanzialmente inascoltati.

Book excerpt: Penal Abolitionism and Transformative Justice in Brazil discusses how penal abolitionism provides fundamental theoretical bases and practical references for the construction of a transformative justice in Brazil, supporting the claim that justice is a socially constructed conception and that victims do not unanimously stand for punishment. The book explores how the active participation of the protagonists of a conflict in a face-to-face negotiation of symbolic reparation, can produce a sense of justice without the need to punish or impose suffering on anyone. Mapping the ways that restorative justice in Brazil has distanced itself from the potential of transformative justice, to the extent that it fails to politicize the conflict and give voice to victims, the book shows how it has resulted in becoming just a new version of penal alternatives with correctionalist content. Moving away from traditional criminal justice language and also from conservative approaches to restorative justice, the author argues that the communicative potential of the transformative kind of redress can be dissociated from the unproved assumption that legal punishment is essential or even likely to achieve justice or deterrence. The arguments are grounded in the Brazilian reality, where life is marked by deep social inequalities and a high level of police violence. By providing a review of the literature on restorative justice, transformative justice, and abolitionism, the book contextualizes the abolitionist debate in Brazil and its history in the 19th century. Penal Abolitionism and Transformative Justice in Brazil is important reading for students and scholars who study punishment and penal abolitionism, to think about what it is possible to do in societies so deeply marked by social injustice and a history of oppression.

His contribution turns on the theory of the suspended middle of the original relationship between the natural and the supernatural, which he experienced and elaborated. The device of the relationship between the original metaphysical-affective-symbolic structure of the believing conscience and the affective turn in metaphysics, intrinsically linked to his trinitarian ontology, allowed Rosmini to elaborate theories and epistemologies from a unitary perspective in various fields of knowledge. This volume indicates the implications of the unbreakable bond between Rosmini’s philosophy and theology in disciplines such as pedagogical science, political science, and juridical science. Following the favorable resolution of the “Rosminian question” the Catholic Church beatified Rosmini in 2007 and in 2018 indicated his theoretical-practical approach as a universal education model to be followed. Book excerpt: This volume offers a new theoretical approach to the analysis of the law/revenge binary, and attempts to dismantle the common idea of revenge as lacking any legal, moral or rational dimension. In contrast, the book puts forward a model of a complex system of justice—which it terms 'vindicatory'—wherein vendetta constitutes an authorized action, the core of which does not (just) lie in vengeance but also in settlement procedures for peace—or 'composition.' The first part of the book ("Vindicatory Justice: Conceptual Analyses and Forerunners") seeks to identify the nature of vindicatory justice and to shed light on the structure of so-called vindicatory systems. In turn, the second part ("Mapping Vindicatory Justice") illustrates, using examples gathered from a range of sociolegal contexts, the dynamic relationship between composition and authorized revenge in vindicatory systems. Taken as a whole, the volume shows that applying a longue durée historical perspective to the study of revenge systems allows us to clearly recognize composition and authorized revenge as features of the same legal system, even though one of them may seem predominant (or more eye-catching) than the other in certain cultural settings.
