Book excerpt: Aujourd'hui, des signaux de plus en plus forts suggèrent que le système des appellations d'origine protégées et des indications géographiques a atteint ses limites. En outre, la concurrence d'autres modèles d'organisation qui s'inscrivent dans des logiques commerciales et économiques différentes, offre une alternative au consommateur et interroge sur l'intérêt de poursuivre dans un système empirique qui ne répond peut-être plus au niveau d'exigence initialement défini. Schématiquement, et malgré la diversité des approches juridiques des différents pays, deux conceptions principales s'opposent au niveau international. La première est fondée sur la référence à un terroir délimité défendu par le système des AOP/IGP (observée notamment dans l'Union européenne) tandis que la seconde s'articule autour de la marque privée (observée en grande partie dans les pays du « Nouveau Monde »). Par la mise en perspective des règles existantes et la comparaison de ces deux systèmes, notre travail de recherche consiste à étudier la possibilité de concevoir juridiquement la gestion d'une appellation d'origine par les producteurs eux-mêmes avec un assouplissement de l'intervention de la puissance publique. L'objectif de la thèse n'est pas tant de remettre en question le modèle des AOP/IGP mais surtout de poser les conditions d'une potentielle réappropriation du nom géographique par une sortie collective des producteurs et d'en mesurer les conséquences sur le plan juridique. L'étude s'interroge ensuite sur l'évolution récente du processus de labellisation des produits à travers les marques de nature collective, qui représentent une stratégie alternative de valorisation et de protection pour les indications géographiques.

This book analyses the evolving nature of EU sui generis GIs by focusing on their key element, the origin link, and concludes that the history of the product in the broad sense has become a major factor to prove the link between a good and a specific place.
