Book excerpt: Depuis quelques années, le concept de la responsabilité contractuelle paraît devenir le centre de gravité de discussions doctrinales animées qui lui attribuent le caractère de problème d'actualité. Notre recherche diffère des analyses précédentes puisqu'il s'agit moins d'envisager la valeur de la distinction entre les deux ordres de la responsabilité civile, que de réfléchir sur la notion de la responsabilité contractuelle et sur son autonomie. De nombreuses interrogations ont trait aujourd'hui à son existence en tant que système autonome de responsabilité réparatrice d'un dommage. Elle est remise en question, à tel point que certains auteurs n'ont pas hésité à lui dénier toute existence. Elle est incontestablement malmenée. Soit la fonction réparatrice des dommages résultant de l'inexécution d'un contrat est écartée au profit d'un système dit "d'exécution par équivalent" ; soit la fonction indemnitaire est maintenue, mais alors cette responsabilité est rapprochée de la responsabilité délictuelle, au mépris des spécificités incontournables de la réparation contractuelle. Nous ne pouvons adhérer ni à l'instauration d'un système d'exécution forcée négateur de la responsabilité contractuelle, ni à l'envahissement de la responsabilité délictuelle. La responsabilité contractuelle mérite une réhabilitation. Son émergence devra être analysée afin de montrer que, dans une double perspective historique et comparative, cette notion recouvre une réalité ancienne qui dépasse aussi nos frontières. En outre, au sein du droit positif français, il ne peut être nié que ce concept présente des particularités, tant dans ses effets que dans ses conditions, qui empêchent son assimilation à un système d'exécution. La distinction entre les remèdes relatifs à l'inexécution et la responsabilité contractuelle est effective; cette dernière est bien une institution réparatrice de dommages qui résultent de cette inexécution. Enfin, cette fonction de réparation commune aux deux responsabilités n'implique pas nécessairement leur identité. Il faut alors, pour confirmer l'autonomie complète de la notion de responsabilité contractuelle et lui redonner un domaine d'application propre, mettre en exergue l'idée que cette réparation est imprégnée par l'existence d'un lien juridique préexistant qui lui attribue un particularisme irréductible.

For long it was based on a mere five articles of the Civil Code of 1804, but on this foundation the courts and legal scholars have constructed liabilities for fault and strict liability of an extraordinary breadth and significance. While the rest of the general law of obligations (including contract) in the Civil Code was reformed in 2016 by executive ordonnance, this area was left aside, being the subject in 2017 of a proposal by the French Government for the legislative reform of the law of civil liability, a new legislative category to include both contractual and extra-contractual liability. This work considers important aspects of this developing area of French law in a series of essays by French lawyers and comparative lawyers working in French law and other civil law systems.
