Book excerpt: Este estudio trata de demostrar que el concepto de «estabilidad en el empleo» está desvinculado de la duración temporal o indefinida del contrato y que, en cambio, se refiere estrictamente a la preservación del negocio jurídico. A la luz de este enfoque, se analizan las diversas manifestaciones que, desde la perspectiva del trabajador y del empresario, promueven la continuidad, con el objeto de sistematizarlas y evaluar la intensidad con la que se persigue este objetivo en el ordenamiento jurídico español. Para llevar a cabo esta tarea, el trabajo parte de la contextualización de la estabilidad en el empleo desde la perspectiva constitucional y, particularmente, del derecho al trabajo. A continuación, se centra, por un lado, en evaluar si opera como un principio jurídico conformador del Derecho del Trabajo; y, por otro, en identificar y analizar de forma ordenada y exhaustiva las reglas jurídico-positivas que, a partir de la reforma de 2010, están impregnadas de esta «idea» de conservación (continuidad del contrato a pesar de su nulidad parcial y en determinados casos de cambio de empresario, la limitación temporal del período de prueba, la tácita reconducción, el «ius variandi», la modificación sustancial de las condiciones de trabajo, la suspensión de la relación de trabajo y la extinción causal). También se analiza qué incidencia tiene la estabilidad en la naturaleza jurídica del contrato de trabajo y cómo afecta en la configuración dogmática de las facultades de alteración unilateral y sobrevenida reconocidas a ambos contratantes, defendiendo que el fundamento es común y radica en el art. 35 de la Constitución.
