Book excerpt: "Desde la imputación formulada se incorpora al proceso penal el objeto de la litis, donde la defensa podrá ejercer su facultad de contradicción, así como el juzgador de resolver desde el criterio de la exigencia. En efecto, el operador puede exigirle al fiscal que explique de manera clara y precisa los cargos que le han formulado al imputado en el marco de una audiencia de tutela de derechos. También, el juez puede exigir al Ministerio Público los elementos de convicción que sustentan el cuadro fáctico imputativo, por ejemplo, en la audiencia de prisión preventiva. Además, el juzgador puede exigir que el fiscal aclare si hay una modificación en su clasificación jurídica en la audiencia de juicio oral para efecto que proceda a formular la acusación complementaria correspondiente. Pero, porque el operador exige no significa la afectación al debido proceso, sino es la consecuencia de amparar la petición justificada de la defensa planteada en el marco del ejercicio de su actividad contradictoria y para no colocar al imputado en un estado de indefensión. En esa inteligencia, la manera cómo se cumpla con los principios de imputación y contradicción apreciaremos el desarrollo del proceso penal y la intervención de los sujetos procesales. Sin embargo, el operador no debe tolerar la imputación indeterminada, expresada en la simple mención de las leyes y sus articulados sin conexión alguna a un cuadro fáctico y a sus elementos de convicción; tampoco se tolera la imputación por la sola razón de ejercer un cargo o rol, sin la explicación a través de las circunstancias de tiempo, lugar y modo de la infracción de un deber jurídico que a su vez actualiza un tipo penal. No obstante, tampoco el operador puede tolerar precisiones abusivas de la defensa, que rompe con la logicidad de la responsabilidad penal. En suma, el principio de imputación constituye la base filosófica del sistema de justicia penal, constructo que, por las razones explicadas en la obra, hemos podido denominar: la pragmática de la imputación penal y que invitamos al lector a su análisis y reflexión para efecto de lograr la coherencia propia de un sistema como es la que se procura con la justicia punitiva".
