There is growing attention on legislation and regulation's role in the waste sector. Regulation can help companies and citizens achieve a faster, more effective, and more efficient transition from a linear economy, based on the take-make-dispose paradigm, to a circular economy, in which the potential of waste as resources and secondary raw materials is exploited. This book is set in the wake of economic literature that tackles the transition from the linear to the circular economy. It focuses on the downstream stages of the waste management process (i.e. the waste treatment phase). In this regard, it is proposed a journey through the history of European waste legislation to study the waste sector's transition dynamics from a selfish and no longer sustainable economic model based on rampant consumerism to a far-sighted sustainable model addressing the well-being of future generations. Studying the changes in European waste regulations leads us to ask ourselves the following questions: how has waste collection changed in recent years? What are the new regulatory challenges that must be addressed to achieve the objectives of a circular economy? How successful has the EU legislation been in fostering the transition from a linear to a circular economy? Finally, has the European environmental legislation sprung a convergence process among European countries towards the circular economy, or has the definition of targets fuelled the already marked differences between EU countries?

Book excerpt: This book draws together debates from two burgeoning fields, liminality and informality studies, to analyze how dynamics of rule-bending take shape in Rome today. Adopting a multiscalar and transdisciplinary approach, it unpacks how gaps and contradictions in institutional rulemaking and application force many residents into protracted liminal states marked by intense vulnerability. By merging a political economy lens with ethnographic research in informal housing, illegal moneylending, unauthorized street-vending and waste collection, the author shows that informalities are not marginal or anomalous conditions, but an integral element of the city’s governance logics. Multiple actors together construct the local cultural norms, conventions and moral economies through which rule-negotiation occurs. However, these practices are ultimately unable to reconfigure historically rooted power dynamics and hierarchies. In fact, they often aggravate weak urbanites’ difficulties in accessing rights and services. A study that challenges assumptions that informalities are predominantly features of developing economies or limited to specific groups and sectors, this volume’s critical approach and innovative methodology will appeal to scholars of sociology and anthropology interested in social theory, urban studies and liminality.

The European Union specifies this principle in EC directives on integrated pollution prevention and control (IPPC), on environmental impact assessment (EIA), and on the control of major accident hazards involving dangerous substances (Seveso II). This is the first book to investigate from both empirical and normative perspectives the effectiveness of these directives at the national level. It provides by far the most extensive comparative analysis and evaluation of the industrial permitting and inspections, EIA, and major accident prevention in the EU. Offering an in-depth study of the transposition and implementation of EC environmental directives in eight EU member states (Denmark, France, Germany, Italy, the Netherlands, Spain, Sweden, and the United Kingdom), the author who has played a significant role in the formulation of environmental legislation and regulation at both the national (German) and EU levelsand¿provides a stable base for an assessment of the benefits and costs of the integrated approach to environmental protection. Among the factors considered are the following: key features of national constitutional, administraand¬tive, and judicial systems which provide the framework for environand¬mental regulations and their implementation in the eight countries under study; procedures and substantive requirements transposing the IPPC, EIA and Seveso II directives into national laws; and evaluation of national deficiencies and the extent of muddling through. The empirical part of Dr Bohne's analysis draws on 138 expert interviews with public and private actors, a survey of 178 public authorities, and document analyses of selected industrial permits and environmental impact statements. His comparative analysis of procedural, organizational, and substantive integration makes it possible to identify and compare national accomplishments in regulatory integration, and offers new insights into the effectiveness and limits of EC law. The study concludes with a discussion of the implications of the findings for European governance and better regulation after the enlargement of the EU. This thoroughly researched, rigorous, and insightful study will be of great interest and value to policymakers, regulators, business people, environmental NGOs, consultants, and lawyers, as well as to students of environmental policies and European governance.
