Pour faire face aux nouveaux défis qui émergent, le secteur a intensifié la modernisation de ses dispositifs législatifs et réglementaires. Cette adaptation traduit la volonté des autorités européennes et nationales de promouvoir le double objectif du soutien à la solidité prudentielle des organismes d’assurance et surtout de l’instauration d’un degré élevé de protection des consommateurs européens. Si le premier dessein a déjà été pris en charge par la directive Solvabilité II, le deuxième fait actuellement l’objet d’une refonte en profondeur portée par la directive 2016/97 du Parlement européen et du Conseil du 20 janvier 2016 sur la distribution d’assurance (DDA). C’est cette réforme et ses conséquences qu’analyse le présent ouvrage. Un ouvrage complet et éclairant sur les dernières nouveautés législatives et réglementaires dans le secteur de l'assurance, par deux enseignants spécialistes du domaine. EXTRAIT Depuis 2002, les modalités d’exercice de l’intermédiation en assurance ont fortement évolué. C’est donc au niveau de la définition organique de cette activité que la directive 2016/97 a le plus apporté de modifications. Jusqu’à présent, les éléments de définition de l’intermédiation en assurance relevaient de la directive 2002/92 du Parlement européen et du Conseil du 9 décembre 2002 (DIA1) et étaient repris par l’article L.511-1 du Code des assurances. Selon le premier niveau de définition, cette activité « consiste à présenter, proposer ou aider à conclure des contrats d’assurance ou de réassurance ou à réaliser d’autres travaux préparatoires à leur conclusion ». Les opérations visées étaient caractérisées par « le fait pour toute personne physique ou personne morale de solliciter ou de recueillir la souscription d’un contrat ou l’adhésion à un tel contrat, ou d’exposer oralement ou par écrit à un souscripteur ou un adhérent éventuel, en vue de cette souscription ou adhésion, les conditions de garantie d’un contrat. » (Article R511-1 du Code des assurances). Toutefois, les interventions portant « exclusivement » sur « la gestion, l’estimation et la liquidation des sinistres » n’étaient pas considérées comme de l’intermédiation en assurance ou en réassurance.
