Book excerpt: L'histoire comme la criminologie sont deux disciplines qui se sont avérées particulièrement précieuses pour ce qui est de la description du phénomène de la criminalité intrafamiliale. L'analyse historique nous a permis de démontrer quelle a été l'évolution des crimes familiaux de l'ancien Code pénal de 1810 au nouveau Code pénal de 1992. (antérieurement incriminations particulières / actuellement circonstances aggravantes). L'analyse criminologique a permis de mettre en évidence tant des mécanismes fondamentaux complexes que des données statistiques. A cet égard, on peut remarquer que le thème des crimes familiaux, semble être le parent pauvre de la criminologie française. Cela a également été l'occasion, pour nous, de s'interroger sur le lien familial et sur la nécessité de retenir une conception restrictive ou à l'inverse élargie de ce dernier. Il nous fallait, pour ainsi dire, mesurer l'étendue du lien de parenté en France. Notre réflexion a été enrichie d'apports comparatifs, ce qui a permis entre autre, de situer notre système répressif actuellement en vigueur, par rapport à ceux de nos voisins Européens. Ainsi, nous avons traités le sujet dans sa globalité, par le biais d'une démarche généraliste et inédite. Parler du droit pénal, qui est le moyen le plus radical de ceux dont dispose la société que ce soit pour protéger ou pour punir, en ce qui concerne la famille peut sembler absurde. Pourtant, cette recherche nous a démontré que le droit pénal se préoccupe de la protection de la famille, en essayant de favoriser son maintien et son fonctionnement. Cependant, nous avons remarqué au cours de nos développements de nombreuses incohérences et imperfections. On ne peut se retenir de reprocher au Code pénal, son manque de clarté et son incertitude vis-à-vis de certains liens de famille et il est à souhaiter une uniformisation des solutions. Enfin, quatre fonctions du droit pénal de la famille ont été relevées. D'une part, la protection et la prévention du milieu familial. D'autre part, le renforcement de l'unité familiale mais aussi la moralisation de la famille. Certains dysfonctionnements ont alors été mis en évidence : poids du secret des familles, débordement de la mission normale du droit pénal sur la sphère familiale.

The causes of criminal behavior in Native Americans may differ from the causes of criminal behavior in other ethnic groups, and the useful preventative strategies may correspondingly differ. This text examines the extent to which those possibilities may be true.
