The newly formed African group consists of judicial experts with both academic and practical background from various parts of Sub-Saharan Africa. The importance of such a group for the African continent cannot be overestimated. Africa plays a vital role in international criminal law and justice, both as an active player at the ICC and at the regional and national level. This book contains some of the papers that were presented at the first meeting of the newly formed African Expert Study Group on International Criminal Law/ Groupe des Experts Africaines en Droit Pénal International held in September 2011 in Brussels, Belgium. The group was established under the auspices of the Multinational Development Policy Dialogue (hereinafter 'MDPD') and the Rule of Law programme of the German Konrad-Adenauer-Stiftung ('KAS') in 2010 modeled on the successful sister group in Latin America. This latter group was originally founded as an expert group to monitor the implementation of the Rome Statute of the International Criminal Court ('ICC') in Latin America within the framework of cooperation between KAS' regional Rule of Law Programme and the Department for Foreign and International Law of the Institute for Criminal Law and Criminal Justice of the Georg-August-Universität Göttingen in 2002. The newly formed African group consists of judicial experts with both academic and practical background from various parts of Sub-Saharan Africa. The importance of such a group for the African continent cannot be overestimated. Africa plays a vital role in international criminal law and justice, both as an active player at the ICC and at the regional and national level. As for the group's composition and outreach, the aim is to broaden regional representation and further consolidate membership. In 2012, the group will meet in Nairobi, Kenya to deal with topics surrounding the 'Potential for the domestic prosecution of international crimes in Africa.' Topics for future meetings abound given the multi-faceted African legal and political practice regarding international criminal justice in general and the ICC in particular. The group should in particular monitor the recent international or transnational criminal justice developments at the regional African level as well as relevant national developments. L’an 1474 marque en effet une avancée considérable pour la justice pénale internationale, notamment avec le procès de Peter Von HAGENSBACH, Grand Bailli d’Alsace, serviteur de Charles le Téméraire, jugé pour ce que l’on appelle aujourd’hui crime de guerre. Ce procès a été source d’inspiration pour l’instauration d’une justice pénale internationale stable. Seulement, c'est au XXème siècle que cette justice connaîtra une avancée remarquable. D'ailleurs, au lendemain de la Seconde Guerre Mondiale, on va assister à la création de tribunaux pénaux internationaux (TPIY, TPIR et TSSL). Cependant, le problème de stabilité n’était pas toujours résolu car ces derniers étaient appelés à disparaître une fois leurs missions remplies. La création d’une juridiction permanente telle que la Cour pénale internationale fut la bienvenue. Elle fut encore très louable, car elle a pour but de collaborer avec les juridictions internes des États dans la lutte contre l’impunité des auteurs des infractions les plus graves telles que les crimes contre l’humanité, crimes de guerre, crimes de génocide et les crimes d’agression. Dès le préambule et à l’article 1er du Statut de Rome, la CPI est décrite comme complémentaire des juridictions nationales. Ceci souligne le problème de rapport entre les deux juridictions. Les rapports qui existent entre la CPI et les juridictions nationales sont de nature complémentaire au niveau de la compétence et collaborative au niveau des poursuites des auteurs des infractions. Ainsi, dans ses rapports avec les juridictions internes des États, la CPI n’a pas la priorité pour connaître les crimes relevant de sa compétence : les États restent les premiers responsables de la lutte contre l’impunité. Elle a une primauté dans la répression si ces derniers ne s’en chargent pas pour quelques motifs que ce soient. Cependant, pour une bonne complémentarité entre la Cour et les juridictions internes, un appel est fait aux États d’une part, à beaucoup plus de coopération avec la Cour et d’autre part, à remplir pleinement leurs missions de lutte contre l’impunité des infractions graves menaçant la paix internationale.

Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.
