Hoy en día, parece que ninguna pregunta importante de derecho privado pueda recibir una respuesta que escaparía a una determinación, o al menos a una influencia constitucional.Sin embargo, el rol reconocido a la Constitución difiere de un estado al otro. Las diferencias se relacionan con múltiples y relevantes aspectos, como la existencia o no de un control de constitucionalidad y las modalidades de dicho control; la mayor o menor atracción que ejercen los recursos conferidos por la constitución en relación con los remedios clásicos del derecho privado, cuyo anquilosamiento contrasta con la eficacia y la rapidez de ciertos remedios de derecho constitucional; o las consecuencias del fenómeno sobre el método de evolución del derecho.Bajo la dirección del profesor Christian Larroumet y con la coordinación académica de Sebastián Ríos Labbé, el Tercer Congreso Internacional de la Association Andrés Bello des Juristes franco-latino-américains, que tuvo lugar los dias 5 y 6 de septiembre de 2006 en las Universidades Externado de Colombia y del Rosario, se dedicó al análisis de todas estas importantes materias. El congreso contó con la participación de cuarenta connotados profesores, venidos de Francia y de diez países de Latinoamérica. Difícilmente una disciplina que estudie el desenvolvimiento de las relaciones humanas, y con mayor razón una que las analice en la perspectiva de su "deber ser", puede llegar a obviar una simpatía con alguna particular tendencia política, así como con la determinada visión del hombre y de la sociedad de la que trae origen. El ideal de una ciencia del Derecho privado neutral es, por tanto, algo vano. Pero, más que un problema que la teoría debe esforzarse aún por evitar, se hace necesario conocer con claridad cuál es la tendencia política que orienta a nuestro ordenamiento privado, para verificar si ella corresponde con los fines socialmente perseguidos. En esto radica el propósito central del trabajo que ahora se introduce. En qué medida es útil la herramienta de los negocios jurídicos para el desarrollo global de una sociedad, es algo que depende en buena medida del enfoque que le brinde su teoría general. Es, por tanto, tarea de esta última identificar plenamente dicho enfoque, en aras de evitar que su omisión haga incurrir en múltiples contradicciones tanto en la teoría como en la práctica de la dinámica social. Pues un estudio consciente de los modelos jurídicos puede hacer evidente su ineptitud para alcanzar las metas que la sociedad de un momento determinado persigue, y en ese momento debe buscarse una salida alternativa, que evite, desde otra perspectiva, caer en las disfunciones de la anterior y que proporcione, por el contrario, una herramienta para contribuir a la armonía social desde la esfera de las relaciones privadas.

Book excerpt: This book explores various approaches around the world regarding price term control, and particularly discusses the effectiveness of two major paths: ex ante regulatory and ex post judicial intervention. Price control and its limits are issues that affect all liberal market economies, as well as more regulated markets. For the past several years, courts in many different countries have been confronted with the issue of whether, and to what extent, they should intervene regarding price-related terms in standard form contracts – especially in the area of consumer contracts. Open price clauses, flat remunerations, price adjustment clauses, clauses giving the seller/supplier the right to ask for additional payments, bundling or partitioning practices, etc.: a variety of price related terms are used to manipulate customers’ choices, often also by exploiting their behavioral biases. The result is an unfavorable contract that is later challenged in court. However, invalidating a given price term in standard forms e.g. of a banking or utilities contract only has an inter partes effect, which means that in thousands if not millions of similar contracts, the same clauses continue to be used. Effective procedural rules are often lacking. Therefore, pricing patterns that serve to hide rather than to reveal the real cost of goods and services require special attention on the part of regulators. The aim of this book is to determine the various approaches in the world regarding price term control, and particularly to discuss the efficiency of both paths, ex ante regulatory and ex post judicial intervention. Thanks to its broad comparative analysis, this book offers a thorough overview of the methods employed in several countries. It gathers twenty-eight contributions from national rapporteurs and one supra-national rapporteur (EU) to the 2018 IACL Congress held in Fukuoka. These are supplemented by a general report presented at the same IACL Congress, which includes a comparative analysis of the national and supranational reports.
