Book excerpt: L'étude de la question de la conciliation entre protection des droits des travailleurs et promotion des libertés économiques dans le cadre du détachement de travailleurs montre que, l'Union européenne étant fondée sur la promotion des libertés économiques, la Cour de justice privilégie la libre prestation de services. Pour autant, on constate que c'est un véritable choix de politique juridique car dans d'autres domaines, ou dans le cadre d'autres ordres juridiques, une telle conciliation n'engendre pas les mêmes résultats. L'intervention du législateur de l'Union par l'adoption d'une directive relative au détachement de travailleurs n'a pas modifié ces conclusions. Pour autant ces solutions amènent aujourd'hui à une situation paradoxale d'un point de vue économique, les États de l'ouest de l'Union dénonçant un dumping social important de la part des entreprises établies dans les États d'Europe centrale et orientale. Ce dumping a amené à l'adoption d'une nouvelle directive en 2018 qui vise à rétablir un équilibre entre protection des droits des travailleurs et promotion de la libre prestation de services. L'analyse approfondie de ce texte et l'influence des arrêts de la Cour de justice laissent toutefois planer des doutes sur l'atteinte d'un tel équilibre.

Book excerpt: L'action collective des travailleurs - qu'on désigne ordinairement en France par le terme de grève - fait l'objet d'un encadrement juridique diversifié au niveau national comme supranational. Les différents régimes de l'action collective se trouvent aujourd'hui confrontés aux libertés économiques garanties par le droit de l'Union européenne, au premier titre desquelles la liberté d'établissement et la libre prestation des services. C'est en 2007, à Luxembourg, que s'est joué le premier acte de cette confrontation, lorsque la Cour de justice de l'Union européenne eut à examiner, dans les affaires Viking et Laval, les circonstances d'une rencontre inédite : celle de l'action collective, telle que régie par les ordres juridiques nationaux, avec les libertés économiques. Dans un second temps et par contrecoup, les instances veillant au respect des textes élaborés au sein de l'Organisation internationale du Travail et du Conseil de l'Europe ont été le lieu d'une rencontre similaire : celle de l'action collective, telle que régie par les ordres juridiques de l'OIT et du Conseil de l'Europe, avec ces mêmes libertés économiques. Cette thèse entend mettre en lumière les évolutions des régimes nationaux et supranationaux de l'action collective, à la suite de leur rencontre avec les libertés économiques. Pour ce faire, deux perspectives sont combinées. Dans une perspective historique, les droits nationaux et supranationaux de l'action collective sont étudiés pour en saisir la construction. A cette fin, l'outil employé est celui de la comparaison juridique, comparaison qui s'effectue à un double niveau, national (droit français et droit anglais) et supranational (droit de l'OIT et droit du Conseil de l'Europe). Dans une perspective plus dynamique, ce sont les interactions des régimes nationaux et supranationaux de l'action collective avec les libertés économiques garanties par le droit de l'Union européenne qui sont examinées, avec pour toile de fond la théorie du pluralisme juridique ordonné. Titulaire de droits fondamentaux opposables aux pouvoirs étatiques dans la cité, il semblait normal qu'il puisse aussi les exercer devant la puissance patronale. Ces garanties sont en effet intrinsèques à tout être humain, universelles et inaliénables. Sous l'effet hiérarchique des instruments prééminents qui les consacrent, les droits et libertés se sont introduits au sein de la relation d'emploi. La nullité des normes du droit du travail qui sont incompatibles sera déclarée. La hiérarchisation des sources en droit du travail le réclame. Ces droits et libertés sont formulés en termes généraux et abstraits, ce qui augure mal de leur usage immédiat dans le monde du travail. L'activité interprétative du juge apparaît indispensable. Dans sa quête du sens des libertés dans le travail, la méthode contextuelle qu'il privilégie débouche sur une aporie. Elle l'incite à prendre en considération l'ensemble du contexte normatif de la relation d'emploi. Les sources propres au droit du travail dictent ainsi le contenu des droits de la personne et posent des conditions à leur exercice en milieu de travail. Elles justifient également de nombreuses restrictions, voire suppressions, apportées par l'employeur. Les mutations subies par la liberté d'expression et le droit à la vie privée des salariés confirment l'effet réducteur de la relation d'emploi sur les protections offertes par la Charte québécoise. Cette façon de juger renverse la pyramide des normes juridiques. Le noyau intangible de ces garanties est affaibli, car les libertés du travailleur ne possèdent plus la même signification que celles des autres citoyens. Des violations se multiplient sous le regard complice du juge, du fait que les intérêts purement privés de l'entreprise, axés sur la productivité et le profit, reçoivent une légitimité avérée. Le rapport de force et les pouvoirs de la figure patronale se fortifient par l'entremise du contentieux des droits fondamentaux en emploi. Le contrôle exercé par l'autorité patronale s'étend parfois jusque dans la vie personnelle du travailleur et compromet la jouissance des libertés hors du travail. Salarié dans l'entreprise, l'individu le demeure désormais dans la cité. S'impose alors la recherche d'un cadre d'analyse plus respectueux de la cohérence du système juridique et favorisant l'épanouissement des droits et libertés du travailleur. Les statuts de salarié et de personne humaine pourront enfin être réconciliés.

Cela ne signifie pas pour autant qu'il fonctionne parfaitement et permet de régler sans heurt tous les différends en matière de relations de travaiL en particulier lorsqu'il s'agit de relations de travail dans le secteur parapublic et dans les services publics. Ces services, dans lesquels le gouvernement investit souvent une importante somme d'argent prélevée sur les deniers publics, sont généralement perçus comme indispensables pour la population, selon divers degrés. En plus d'être impliqué dans ces services comme bailleurs de fonds et souvent comme employeur, le gouvernement doit également veiller au bien-être de la population. Le déclenchement de grèves dans ces services soulève des problèmes particuliers et suscite parfois l'adoption de mesures draconiennes pour mettre fin aux conflits. Notre étude, basée sur deux conflits de travail, à savoir la grève illégale des infirmières (1999) et la grève légale des mécaniciens d'entretien de la Société de transport de la communauté urbaine de Québec (2000), s'intéresse au contexte d'adoption de lois spéciales forçant le retour au travail. Afin de bien situer ces conflits, nous avons, dans un deuxième temps, présenté le cadre juridique qui leur est applicable, incluant les grands principes de droit international du travail, de la Charte canadienne des droits et libertés et de la Charte des droits et libertés de la personne et du droit québécois du travail. Ce dernier a fait l'objet d'une attention particulière puisque nous avons exposé le régime général de négociation collective prévu par le Code du travail québécois ainsi que les régimes particuliers encadrant le secteur parapublic et les services publics, notamment la notion de services essentiels. La notion de loi spéciale a également été présentée. De plus, une mise en contexte factuelle a permis de dégager les enjeux relatifs à l'épo.

It is a unique document about what it is to grow up a Muslim in Western Europe today and how an extremist is made. In Zacarias, My Brother, author Abd Samad Moussaoui describes the struggle that young Arab men and their families endure in Europe, seeking an education and equal opportunity, only to find most avenues of assimilation effectively barred to people of color. At the same time, he authoritatively details the techniques of the extremist sects that recruit potential terrorist cadres. Members of the Wahhabi sect have perfected a rhetoric that appeals to the wounded pride of these young Arab men, Moussaoui writes—for example, offering funds to help them complete their education. Moussaoui deplores the route taken by his brother. He is not in any way an apologist for terrorism. Even so, he shows convincingly that normal young men can end up terrorists, and suggests how and why this happens. Moussaoui shows with gripping clarity how Wahhabism distorts true Islamic faith and the threat it poses to Islam. And his book strongly suggests that the best defense against terrorist groups like the Wahhabi sect in the future is anything people can do to end racism.
