Si a ello se suma la imposibilidad de transformar el consenso total en la determinación de reglas concretas de reparto, como las que derivan del formulary apportionment, se puede afirmar que el predominio del principio de plena competencia como estándar internacional de distribución de los beneficios está lejos de ser superado.La evolución de éste principio, especialmente en los años más recientes, ha configurado un sistema de elementos y conceptos jurídicos indeterminados como la "sustancia" o la "racionalidad comercial" de las operaciones vinculadas, que dejan un amplio margen de interpretación en cada ordenamiento jurídico, alejándose de los propósitos unificadores que le han acompañado desde su origen.Con la publicación de las recomendaciones de BEPS la relación entre el principio de plena competencia y el objetivo de lucha contra la elusión fiscal fue fortalecida. Según la tesis de la autora, este desarrollo del principio de plena competencia ha llevado a una doble vertiente para entender su naturaleza jurídica actual: como criterio de valoración y como mecanismo antiabuso.La aplicación del principio de plena competencia se ha extendido e integrado en los tres niveles relevantes para el análisis de las operaciones vinculadas en el régimen jurídico español: internacional, europeo y nacional.Un estudio completo y conjunto de estas tres perspectivas permite ver cuál es el límite que puede darse a la aplicación e interpretación del art. 18 de la LIS 27/2014, especialmente ad portas de los primeros pronunciamientos judiciales por parte de los tribunales españoles en aplicación del mismo.

This book provides background on the risks relevant in water systems planning, the different approaches to scenario definition in water system planning, and an introduction to the decision-scaling methodology upon which the decision tree is based. The decision tree is described as a scientifically defensible, repeatable, direct and clear method for demonstrating the robustness of a project to climate change. While applicable to all water resources projects, it allocates effort to projects in a way that is consistent with their potential sensitivity to climate risk. The process was designed to be hierarchical, with different stages or phases of analysis triggered based on the findings of the previous phase. An application example is provided followed by a descriptions of some of the tools available for decision making under uncertainty and methods available for climate risk management. The tool was designed for the World Bank but can be applicable in other scenarios where similar challenges arise.
