Available in PDF, EPUB and Kindle. Book excerpt: The protection of software is currently quite a controversial issue. In France, software as such is only able to be protected by copyright. At a European level, the tendency is to accept the protection of software through patent law in some cases. With this in mind, the European Commission has submitted a draft Directive on the patentability of software. However, this project has met with very strong opposition from the partisans of free software. There is therefore a distortion of case law between the French judge and the European judge on the patentability of software. It is also interesting to compare this distortion with the software protection system in the United States, which accepts its protection via patent law. A legal discussion is therefore required on this subject, with a view to harmonisation of the protection systems in a context of globalisation. To do this, the meaning of "software" and "patentable invention" must be defined much more precisely, and it must be determined whether the conditions of patentability (novelty, inventive activity, industrial application) in France and in Europe are transposable to software. Moreover, within the framework of a comparative study, we should take inspiration from the legislation and case law of the United States.

Extrait: Un brevet est un titre de propriete industrielle qui confere a son titulaire non pas un droit d'exploitation, mais un droit d'interdiction de l'exploitation par un tiers de l'invention brevetee. Ce titre a une duree limitee, generalement 20 ans. Le brevet n'est valable que sur un territoire determine, pour un Etat determine. Ainsi, le brevet est-il toujours national. Il est possible de deposer une demande de brevet pour un Etat (aupres de l'INPI pour la France, de l'USPTO pour les USA, du JPO pour le Japon...), ou pour un groupe de pays (aupres de l'OEB pour 36 pays europeens, depot d'une demande de brevet PCT pour les 142 pays signataires du Traite de cooperation en matiere de brevets). Ainsi, si une demande de brevet peut couvrir plusieurs Etats, a la delivrance, il y aura toujours autant de brevets nationaux que d'Etats dans lesquels une protection est recherchee. En contrepartie, l'invention doit etre divulguee au public: en pratique, les brevets sont automatiquement publies 18 mois apres la date de priorite, c'est-a-dire le premier depot, sauf cas particuliers. Dans le cas de brevets visant des produits pharmaceutiques ou phytosanitaires, le titre peut toutefois etre prolonge pour une duree maximale de 5 ans par un certificat complementaire de protection (reglement CE 1768/92). C'est a Sybaris en Grande Grece durant l'Antiquite qu'est apparu la premiere fois un regime de propriete intellectuelle similaire aux brevets.
