Book excerpt: La D.A. 6a de la Ley 9/2013, de 4 de julio, por la que se modifica la Ley 16/1987, de 30 de julio, de Ordenación de los Transportes Terrestres y la Ley 21/2003, de 7 de julio, de Seguridad Aérea, introdujo, para los supuestos de intermediación en la contratación de los transportes terrestres, la posibilidad de que el transportista que efectivamente haya realizado el traslado se dirija, mediante acción directa, en caso de impago del precio del transporte por quien lo haya contratado, y por la parte impagada, contra el cargador principal (como lo llama la norma) así como contra todos los que puedan precederle en la cadena de subcontratación articulada para la ejecución del contrato. Mas siendo la ausencia de regulación completa predicable de todas las acciones directas previstas en el ordenamiento español, aún resulta más acuciante respecto de la acción directa en el transporte terrestre. De hecho, si el funcionamiento de cada acción directa se ha ido perfilando desde las escasas pinceladas establecidas en los preceptos legales que se dedican a su reconocimiento, conforme se han ido planteando problemas en su aplicación práctica; en el caso de la acción directa en el transporte terrestre se ha ido concretado, por los tribunales, hasta llegar al Tribunal Supremo, precisamente, sobre la base de lo que el precepto que la establece silencia. Sobre lo que no dice, por tanto, en comparación, sobre todo, con lo que sí desvela el 1.597 del Código civil respecto de la acción directa en el arrendamiento de obra y, al mismo tiempo, en contraposición al régimen de esta. Resulta así que la acción directa del transporte terrestre de mercancías es muy distinta, en su funcionamiento y configuración, a la del arrendamiento de obra, establecida en favor del subcontratista contra el dueño de la misma (artículo 1.597 del C.c.), con la que, en un principio, era fácil entablar paralelismo por la consabida proximidad de los mencionados contratos. Todo ello es objeto de análisis pormenorizado en la presente obra, que ofrece así un estudio completo del funcionamiento y el régimen jurídico de la acción directa del transporte terrestre, partiendo del análisis de los recientes pronunciamientos jurisprudenciales sobre esta particular forma de garantía, pero yendo, a su vez, más allá de lo expresamente establecido en ellos.

The challenges have grown with the COVID-19 pandemic and related containment measures. This report presents the first global assessment of food insecurity and malnutrition for 2020 and offers some indication of what hunger might look like by 2030 in a scenario further complicated by the enduring effects of the COVID-19 pandemic. It also includes new estimates of the cost and affordability of healthy diets, which provide an important link between the food security and nutrition indicators and the analysis of their trends. Altogether, the report highlights the need for a deeper reflection on how to better address the global food security and nutrition situation. To understand how hunger and malnutrition have reached these critical levels, this report draws on the analyses of the past four editions, which have produced a vast, evidence-based body of knowledge of the major drivers behind the recent changes in food security and nutrition. These drivers, which are increasing in frequency and intensity, include conflicts, climate variability and extremes, and economic slowdowns and downturns – all exacerbated by the underlying causes of poverty and very high and persistent levels of inequality. In addition, millions of people around the world suffer from food insecurity and different forms of malnutrition because they cannot afford the cost of healthy diets. From a synthesized understanding of this knowledge, updates and additional analyses are generated to create a holistic view of the combined effects of these drivers, both on each other and on food systems, and how they negatively affect food security and nutrition around the world. In turn, the evidence informs an in-depth look at how to move from silo solutions to integrated food systems solutions. In this regard, the report proposes transformative pathways that specifically address the challenges posed by the major drivers, also highlighting the types of policy and investment portfolios required to transform food systems for food security, improved nutrition, and affordable healthy diets for all. The report observes that, while the pandemic has caused major setbacks, there is much to be learned from the vulnerabilities and inequalities it has laid bare. If taken to heart, these new insights and wisdom can help get the world back on track towards the goal of ending hunger, food insecurity, and malnutrition in all its forms.
