Book excerpt: L'étude des aspects actuels de l'évolution du gage français montre qu'il y a aujourd'hui un véritable désordre, le modèle du Code civil ne correspond plus à la pratique de cette sûreté. Le gage est devenu la sûreté mobilière la plus diversifiée. Est-il alors possible d'uniformiser toutes ces variations sur le modèle du gage? Des nouvelles approches des règles du gage, telles que la "dématérialisation" et la "valeur engagée" se supersosent aux conceptions traditionnelles qui montrent leur insuffisances. La place non primordiale de l'idée de "valeur" en droit français constitue une raison principale de comparaison avec le droit musulman où la notion de "valeur engagée" joue un rôle primordial déterminant les obligations et les droits des parties. Les juriconsultes considèrent que le droit du créancier gagiste ne porte pas en effet sur la chose gagée mais sur sa valeur, de sorte que cette valeur constitue l'objet du gage. L'idée de "valeur engagée" constitue aujourd'hui dans la doctrine française une des nouvelles approches des règles du gage. Le droit réel découlant du contrat de gage ne peut être conçu comme un pouvoir direct sur une chose déterminée. L'analyse classique qui définit la possession comme un pouvoir de fait sur un bien et qui considère qu'elle ne peut s'appliquer à un bien incorporel est critiquable. Afin de montrer l'appplicabilité de la possession aux biens incorporels, on estime que la dématérialisation du droit de retention du créancier gagiste, comme dans le gage des instruments financiers ou gage sur véhicule, souligne les insuffisances de l'acceptation traditionnelle du "corpus possessoire". La notion de valeur ne constitue pas une spécificité des nouvelles sûretés portant sur des biens immatériels, mais elle gouverne l'ensemble des sûretés réelles mobilières. Les gages des biens immatériels peuvent apparaître simplement comme la forme la plus éalborée de l'instituion du gage dont la particularité est de porter non sur le bien pris dans son individudalité, mais directement sur sa valeur. Dans la mesure où le bien est, dans sa substance, une valeur, le gage qui grève un bien porte en réalité sur cette valeur. Cette idée aboutit à ne pas faire de distinction entre matérialité et immatérialité de l'assiette du gage. L'uniformisation de toutes les sûretés réelles mobilières sur le modèle du gage ne relève donc pas d'un mythe.
