La présente étude propose d'analyser l'évolution contemporaine de la notion de brevetabilité en observant d'abord l'élargissement du domaine de la brevetabilité, avant de s'intéresser à l'assouplissement des conditions de brevetabilité. Les vecteurs de cette évolution vers une plus grande protection sont la lacune législative en matière de définition de l'invention et le recul successif des exclusions à la brevetabilité. Il ressort en outre de l'étude que le critère d'application industrielle doit être vu comme participant de la nature de l'invention, et non comme une condition de brevetabilité. Il apparaît également qu'en réaction à la complexité des nouvelles technologies et à la pression des acteurs économiques, les conditions de nouveauté et d'activité inventive se voient particulièrement assouplies. L'étude conclut a un abaissement du seuil de brevetabilité et à la prolifération de brevets de mauvaises qualité ayant un impact négatif sur l'innovation.

Book excerpt: At a time when Internet use is closely tracked and social networking sites supply data for targeted advertising, Lars Heide presents the first academic study of the invention that fueled today’s information revolution: the punched card. Early punched cards helped to process the United States census in 1890. They soon proved useful in calculating invoices and issuing pay slips. As demand for more sophisticated systems and reading machines increased in both the United States and Europe, punched cards served ever-larger data-processing purposes. Insurance companies, public utilities, businesses, and governments all used them to keep detailed records of their customers, competitors, employees, citizens, and enemies. The United States used punched-card registers in the late 1930s to pay roughly 21 million Americans their Social Security pensions, Vichy France used similar technologies in an attempt to mobilize an army against the occupying German forces, and the Germans in 1941 developed several punched-card registers to make the war effort—and surveillance of minorities—more effective. Heide’s analysis of these three major punched-card systems, as well as the impact of the invention on Great Britain, illustrates how different cultures collected personal and financial data and how they adapted to new technologies. This comparative study will interest students and scholars from a wide range of disciplines, including the history of technology, computer science, business history, and management and organizational studies.

Once seen by many as a colonial interloper in the South Pacific, by the early 2000s, after it ended nuclear testing in French Polynesia and negotiated transitional Accords responding to independence demands in New Caledonia, France seems to have become generally accepted as a regional partner, even if its efforts concentrate on its own territories rather than the independent island states. But Frances future in the region has yet to be secured. By 2014 it is to have handed over a set of agreed autonomies to the New Caledonian government, before an independence referendum process begins. Past experience suggests that a final resolution of the status of New Caledonia will be divisive and could lead once again to violent confrontations. In French Polynesia, calls continue for independence and for treatment under UN decolonisation procedures, which France opposes. Other island leaders are watching, so far putting faith in the Noumea Accord, but wary of the final stages. The issues and possible solutions are more complex than the French Pacific island population of 515,000 would suggest. Combining historical background with political and economic analysis, this comprehensive study offers vital insight into the intricate history -- and problematic future -- of several of Australias key neighbours in the Pacific and to the priorities and options of the European country that still rules them. Book excerpt: In The Path Not Taken, Jeff Horn argues that—contrary to standard, Anglocentric accounts—French industrialization was not a failed imitation of the laissez-faire British model but the product of a distinctive industrial policy that led, over the long term, to prosperity comparable to Britain's. Despite the upheavals of the Revolution and the Napoleonic Wars, France developed and maintained its own industrial strengths. France was then able to take full advantage of the new technologies and industries that emerged in the "second industrial revolution," and by the end of the nineteenth century some of France's industries were outperforming Britain's handily. The Path Not Taken shows that the foundations of this success were laid during the first industrial revolution. Horn posits that the French state's early attempt to emulate Britain's style of industrial development foundered because of revolutionary politics. The "threat from below" made it impossible for the state or entrepreneurs to control and exploit laborers in the British manner. The French used different means to manage labor unruliness and encourage innovation and entrepreneurialism. Technology is at the heart of Horn's analysis, and he shows that France, unlike England, often preferred still-profitable older methods of production in order to maintain employment and forestall revolution. Horn examines the institutional framework established by Napoleon's most important Minister of the Interior, Jean-Antoine Chaptal. He focuses on textiles, chemicals, and steel, looks at how these new institutions created a new industrial environment. Horn's illuminating comparison of French and British industrialization should stir debate among historians, economists, and political scientists.
