Book excerpt: Over the last few decades, both the European Union and European States have been implementing various strategies to externalize border controls with the declared intent of saving human lives and countering smuggling but with the actual end result of shifting borders, circumventing international obligations and ultimately preventing access to Europe. What has been principally deplored is the fact that externalizing border controls risks creating ‘legal black holes’. Furthermore, what is particularly worrying in the current European debate is the intensification of this practice by multiple arrangements with unsafe third countries, exposing migrants and asylum seekers to serious human rights violations. This book explores whether European States can succeed in shifting their responsibility onto Third States in cases of human rights violations. Focusing, in particular, on the 2017 Italy-Libya Memorandum of Understanding, the book investigates the possible basis for triggering the responsibility of outsourcing States. The second part of the book examines how the Italy-Libya MoU is only a small part of a broader scenario, exploring EU policies of externalization. A brief overview of the recent decisions of the EU Court vis-à-vis two aspects of externalization (the EU-Turkey statement and the issue of humanitarian visas) will pave the way for the conclusions since, in the author’s view, the current attitude of the Luxembourg Court confirms the importance of focusing on the responsibility of European States and the urgent need to investigate the possibility of bringing a claim against the outsourcing States before the Court of Strasbourg. Offering a new perspective on an extremely topical subject, this book will appeal to students, scholars and practitioners with an interest in European Law, International Law, Migration and Human Rights.

It aims to cast light upon the various questions of international law raised by the matter. The answers may help improve international relations in the region. In 1915-1916, roughly a million and a half Armenians were murdered in the territory of the Ottoman Empire, which had been home to them for centuries. Ever since, a dispute between Armenians and Turkey has been ongoing over the qualification of the massacres. The contributors to this volume examine the legal nature and consequences of this event. Their investigation strives to be completely neutral and technical. The essays also look at the broader issue of denial. For instance, in Turkey, public speech on the matter can still trigger criminal prosecution whereas in other European States denial of genocide, war crimes and crimes against humanity is criminalized. However, the European Court of Human Rights views criminal prosecution of denial of the Armenian massacres as unlawful. In addition, one essay considers a state’s obligation to remember by looking at lessons learnt from the Inter-American Court of Human Rights. Another contributor looks at a collective right to remember and some ideas to move forward towards a solution. Moreover, the book explores the way the Armenian massacres have affected the relationship between Turkey and the European Union.

Book excerpt: Drawing upon extensive experience of both theoretical and empirical research, according to the Italian school of Political Science, this book provides a holistic assessment of contemporary world politics. It begins by defining concepts such as “world order”, before going on to classify foreign policies into four models of political cultures: namely, the “interests-intensive” conservative; the “ideologies-intensive” liberal, the leftist constructivist, and the leftist Manichean. The volume shows how multipolar and bipolar systems have remained relatively stable, with each main power defending its own interests, yet ultimately not promoting ideas and order. Change periods, however, are instable. Between 1915 and 1945, Nazi-fascist and communist ideologies emerged, but, after Yalta, the West did not effectively export market, democracy and peace to the Third World. After 1989, the ideas of liberalism (in economic globalization and EU enlargement), neo-conservatism (in the Iraq war), and multi-cultural leftism (in pluri-national conflict resolution processes) began to be applied toward a “near” world order. Since 2001, Islamic fundamentalism’s threat has prevented both stability (with the failure of the concert of powers of the 1990s), and order (with minimal improvements in democracy and peace). Following the Arab Spring, Obama has also abandoned interests-intensive conservative diplomacy, no longer supporting “lesser evils” (personalistic or military regimes) against “absolute evils” (such as the Islamic State), and waged only “low intensity” wars in Iraq, Syria and Libya.
