Les organes du Mécanisme jouent un rôle crucial dans la centralisation de l’application du droit international des échanges du fait de leur place au sein de la structure de l’OMC, et en raison des compétences juridictionnelles qu’ils exercent. Toutefois, l’action unilatérale des Membres de l’Organisation reste déterminante pour le bon fonctionnement de ce Mécanisme. La saisine de l’Organe de règlement des différends (ORD) sur requête unilatérale, de même que la mise en oeuvre de contre-mesures en cas d’inexécution des décisions de l’ORD, en sont les meilleures preuves. En outre, les rapports des groupes spéciaux (GS) et de l’Organe d’appel (OA) incorporés à ces décisions constituent un droit dérivé jurisprudentiel d’une importance toujours croissante. Enfin, le Mécanisme est au service d’une institution internationale qui n’est pas close sur elle-même. En effet, les organes du Mécanisme interprètent les traités de l’OMC conformément aux règles du droit international coutumier. Et, la production juridique de ces organes est un facteur de modification des normes des ordres juridiques des Membres de l’Organisation, ainsi que des Accords commerciaux régionaux (ACR) auxquels les Membres peuvent être parties.

In this sense, national legal systems expressed through national languages organize the Law based on their own understanding of reality. International Law becomes, in this context, the meeting point where different legal cultures and different views of world intersect. The diversity of languages and legal systems can enrich the possibilities of understanding and developing international law, but it can also represent an instability and unsafety factor to the international scenario. This multilegal-system and multilingual scenario adds to the complexity of international law and poses new challenges. One of them is legal translation, which is a field of knowledge and professional skill that has not been the subject of theoretical thinking on the part of legal scholars. How to negotiate, draft or interpret an international treaty that mirrors what the parties, – who belong to different legal cultures and who, on many occasions, speak different mother tongues – ,want or wanted to say? By analyzing the decision-making process and the legal discourse adopted by the WTO’s Appellate Body, this book highlights the active role of language in diplomatic negotiations and in interpreting international law. In addition, it also shows that the debate on the effectiveness and legitimacy of International Law cannot be separated from the linguistic issue.

Ces dernières années ont été marquées par le développement rapide des échanges commerciaux internationaux et des flux d'investissements étrangers directs. Cette expansion a favorisé la libéralisation des législations nationales dans ces deux domaines et la prolifération des accords bilatéraux, régionaux ainsi que l'ouverture des travaux au sein de l'Organisation de coopération et de développement économiques et de l'Organisation mondiale du commerce en vue de l'adoption des règles multilatérales applicables à l'investissement étranger direct. Certes une réglementation existe en matière de commerce international et d'investissement étranger direct, mais elle est encore fragmentaire. A l'avenir, cette réglementation est appelée à se renforcer au terme d'une négociation multilatérale. Dès lors, l'élaboration sous l'égide de l'Organisation mondiale du commerce de nouvelles règles touchant à la fois l'investissement étranger direct et le commerce international semble être une alternative crédible. Ces règles uniformes à vocation universelle devraient être dotées d'une force juridique obligatoire pour mieux répondre à l'internationalisation des entreprises et à l'interdépendance des économies. Une telle action au plan multilatéral garantit un ancrage solide des liens entre le commerce international et l'investissement étranger direct dans la sphère juridique. Il s'agit en effet d'établir un cadre juridique multilatéral comportant des normes élevées pour la libéralisation et la protection des investissements internationaux, avec un système efficace de règlement des différends.

The 2018 TZG updates and expands on the guidance in the one previous jointly-developed, zoonoses-specific guidance document: the 2008 Tripartite “Zoonotic Diseases: A Guide to Establishing Collaboration between Animal and Human Health Sectors at the Country Level”, developed in WHO South-East Asia Region and Western Pacific Region. The 2018 TZG supports building by countries of the resilience and capacity to address emerging and endemic zoonotic diseases such as avian influenza, rabies, Ebola, and Rift Valley fever, as well as food-borne diseases and antimicrobial resistance, and to minimize their impacts on health, livelihoods, and economies. It additionally supports country efforts to implement WHO International Health Regulations (2005) and OIE international standards, to address gaps identified through external and internal health system evaluations, and to achieve targets of the Sustainable Development Goals. The 2018 TZG provides relevant country ministries and agencies with lessons learned and good practices identified from country-level experiences in taking OH approaches for preparedness, prevention, detection and response to zoonotic disease threats, and provides guidance on multisectoral communication, coordination, and collaboration. It informs on regional and country-level OH activities and relevant unisectoral and multisectoral tools available for countries to use.
