Ce relativisme affecte tous les aspects de la fiscalité personnelle des dirigeants. Ainsi, l'imposition de leurs rémunérations porte sur des questions diverses : leur qualification juridique, la définition de leur disponibilité, leur déductibilité des résultats de l'entreprise, l'appréciation de leur caractère exagéré ou encore les régimes des avantages en nature, des stock-options ou des indemnités de licenciement. Mais, désormais, les dirigeants d'entreprises ne sont plus soumis uniquement à l'impôt sur le revenu. La création de l'impôt sur la fortune (ISF) pose la question complexe de la définition des biens professionnels exemptés appartenant aux dirigeants d'entreprises. Cette exemption est entendue d'une manière plus restrictive que celle des biens affectés à l'activité de l'entreprise. Enfin, l'optimisation du rendement fiscal et la lutte contre l'évasion fiscale ont entraîné le développement inquiétant des solidarités fiscales et pénales pesant sur les dirigeants d'entreprises. Ainsi, l'administration n'hésite pas à mettre en jeu leur responsabilité solidaire devant le juge de l'impôt ou le juge pénal. Grâce à une analyse de la jurisprudence et de la doctrine administrative, des vues inédites se dégagent et des rapprochements opportuns sont opérés. Les deux auteurs qui connaissent bien la fiscalité, à la fois comme professeurs et comme consultants, présentent une synthèse de la matière. Ils apportent ainsi une contribution très utile à l'étude d'un domaine vaste, parsemé d'embûches, qui n'avait pas fait l'objet d'une réflexion aussi complète.

For Luxembourg tax purposes, these prices have to adhere to the "arm?s length principle".0The arm?s length principle is the international transfer pricing standard that OECD member countries have agreed should be used for tax purposes by MNE groups and tax administrations. 0The arm?s length principle is firmly ingrained in Luxembourg tax law and has been explicitly stated in article 56 of the Luxembourg Income Tax Law (LITL).
