Or les droits de l'homme numérique promeuvent la liberté et la souveraineté individuelles, afin que nous ne devenions pas des « auto-hommes ». Ces droits défendent notre humanité commune face aux menaces de la posthumanité et de la transhumanité. L'humanisme juridique n'appartient plus seulement à l'histoire du droit ; il est également son avenir. Il aura remporté la bataille lorsque les êtres humains auront retrouvé le goût, comme dirait Montaigne, de vivre et penser « à sauts et à gambades » plutôt qu'« à clic et à scrolling ».

Très souvent cités en tant qu’outils révolutionnaires, les systèmes d’IA peuvent apporter de nombreux avantages, mais ils peuvent également soulever des questions complexes et importantes sur les plans juridique, éthique, politique et économique. Cette publication vise à alimenter les réflexions en cours au sein du CAHAI sur l’analyse des défis posés par les systèmes d’IA et les réponses réglementaires possibles. Tout d’abord, elle vise à informer le lecteur de l’avancement des travaux du Comité ad hoc sur l’intelligence artificielle (CAHAI) et elle présente plusieurs études réalisées dans le cadre du CAHAI. Deuxièmement, elle présente les perspectives nationales de différents États observateurs, l’Israël, le Japon et le Mexique, afin de soutenir le développement d’un cadre juridique international de l’intelligence artificielle basé sur les normes établies par le Conseil de l’Europe.

These principles aim to guarantee to all the access to an enforcement agent and a quality enforcement in the respect of the fundamental rights of the litigants. In the first part of the book, reference is made to the genesis of the CEPEJ Guidelines on Enforcement as well as to its state of application in the various Council of Europe Member States. The second part of the book deals with the problem of the evolution of technologies and aims to question how artificial intelligence can be put at the service of enforcement. In this respect, the analysis focuses on the importance of both electronic access to information and access to dematerialised information, to highlight the imperative need for a procedure for seizure of dematerialised assets and to consider drafting the a crypto-currency attachment procedure. *** Le 17 décembre 2009, la Commission européenne pour l’efficacité de la justice du Conseil de l’Europe a adopté des Lignes directrices pour une meilleure mise en œuvre de la recommandation existante du Conseil de l’Europe sur l’exécution. Book excerpt: Ideology in the Supreme Court is the first book to analyze the process by which the ideological stances of U.S. Supreme Court justices translate into the positions they take on the issues that the Court addresses. Eminent Supreme Court scholar Lawrence Baum argues that the links between ideology and issues are not simply a matter of reasoning logically from general premises. Rather, they reflect the development of shared understandings among political elites, including Supreme Court justices. And broad values about matters such as equality are not the only source of these understandings. Another potentially important source is the justices' attitudes about social or political groups, such as the business community and the Republican and Democratic parties. The book probes these sources by analyzing three issues on which the relative positions of liberal and conservative justices changed between 1910 and 2013: freedom of expression, criminal justice, and government "takings" of property. Analyzing the Court's decisions and other developments during that period, Baum finds that the values underlying liberalism and conservatism help to explain these changes, but that justices' attitudes toward social and political groups also played a powerful role. Providing a new perspective on how ideology functions in Supreme Court decision making, Ideology in the Supreme Court has important implications for how we think about the Court and its justices.
