De nouveaux concepts issus du droit américain de la faillite ont ainsi été intégrés en droit français. Il s’agit principalement de la procédure de sauvegarde dont l’ouverture ne nécessite pas l’état de cessation des paiements du débiteur, des comités des créanciers, de l’offre d’une seconde chance au débiteur et de la possibilité d’établir un plan de réorganisation avant l’ouverture d’une procédure : la procédure de sauvegarde financière accélérée. L’influence du droit américain de la faillite motivée par la pratique est omniprésente dans les procédures de sauvegarde et de redressement judiciaire. L’étude de cette influence nous conduit à nous demander quel est son devenir en droit français. L’inspiration américaine est à souhaiter pour certains aspects tels que l’adoption d’un patrimoine d’affectation, des prérogatives plus importantes pour le débiteur ou encore la certitude pour les créanciers de recouvrer au moins ce qu’ils auraient perçu dans le cadre d’une liquidation judiciaire. A l’inverse, les défaillances du système américain de la faillite mises en évidence ces derniers temps, de même que la prise en compte du caractère international de la faillite, doivent servir de limites à l’influence du droit américain de la faillite.

Book excerpt: Negritude has been defined by Léopold Sédar Senghor as "the sum of the cultural values of the black world as they are expressed in the life, the institutions, and the works of black men." Sylvia Washington Bâ analyzes Senghor's poetry to show how the concept of negritude infuses it at every level. A biographical sketch describes his childhood in Senegal, his distinguished academic career in France, and his election as President of Senegal. Themes of alienation and exile pervade Senghor's poetry, but it was by the opposition of his sensitivity and values to those of Europe that he was able to formulate his credo. Its key theme, and the supreme value of black African civilization, is the concept of life forces, which are not attributes or accidents of being, but the very essence of being.
