Tiraillée entre exonération totale fondée sur la force majeure et exonération partielle appuyée par la faute, elle est également dissoute au sein de régimes dérogatoires, tels l’acceptation des risques ou les prédispositions de la victime. Cela ne facilite pas son appréhension. Une unité doit être redonnée à ce régime. Il doit s’appuyer sur le lien de causalité, en veillant à sanctionner les comportements répréhensibles des victimes lors de la réalisation du dommage. Dès lors, la faute de la victime doit s’articuler entre ces deux nécessités, en ne s’intéressant qu’aux situations dans lesquelles un fait anormal ayant eu une influence sur le lien de causalité peut être opposé à la victime. Cela implique la restriction de l’application de la théorie de l’acceptation des risques, le remplacement de la force majeure au profit de la cause exclusive, ou enfin la possibilité de sanctionner la victime pour son comportement postérieur au dommage.

For long it was based on a mere five articles of the Civil Code of 1804, but on this foundation the courts and legal scholars have constructed liabilities for fault and strict liability of an extraordinary breadth and significance. While the rest of the general law of obligations (including contract) in the Civil Code was reformed in 2016 by executive ordonnance, this area was left aside, being the subject in 2017 of a proposal by the French Government for the legislative reform of the law of civil liability, a new legislative category to include both contractual and extra-contractual liability. This work considers important aspects of this developing area of French law in a series of essays by French lawyers and comparative lawyers working in French law and other civil law systems. In doing so, it provides insight into the doctrinal thinking and judgments of French lawyers as well as the possible directions in which this area of the law may be developed in the future.

Increasingly there is a feeling that performance management alone will not solve this crisis. Citizens also expect from politicians and public servants ethical responsible conduct. As to the ethics, however, there is a problem. Governance and new public management have raised new problems which cannot be solved by referring to the traditional bureaucratic ethics. Devolution and decentralisation processes have enhanced the responsibility of public servants. The increase of transparency and openness and the service orientation of public organisations have challenged the traditional values of discretion and equality before the rule. The growing interaction between the public and the private sector have raised the question of integrity. In light of these developments, it is important to update the ethical system, or reversibly, the traditional values of the public service can question some actual evolutions in government.
