Book excerpt: Cette thèse tend à rechercher si les États membres de la Convention européenne des droits de l'homme appliquent de manière effective les prohibitions de la torture et des traitements inhumains et dégradants institués par l'article 3 de la CEDH. L'analyse du droit interne indique que la mise en oeuvre de cette disposition présente un aspect contradictoire : si l'application répressive de l'article 3 s'avère être de portee limitée, les États européens développent depuis peu une application préventive qui se révèle plus efficace. La première partie met en lumière le fait que malgré la reconnaissance du caractère normatif et de la valeur suprême de la prescription européenne par l'ensemble des États membres, l'impact de celle-ci sur la pratique administrative et la jurisprudence nationales demeure limité. La seconde partie montre que les pays européens ajustent leur droit interne aux dispositions préventives européennes en réorientant les garanties procédurales existantes vers un renforcement de la protection des droits à l'intégrité de l'individu et en développant les mesures extra-procédurales non contentieuses censées prévenir les atteintes à la dignité humaine.

Book excerpt: An important provision of the European Convention on Human Rights is that in the event of a violation being found, not only is the state in question required to redress the consequences of the violation vis-á-vis the applicant - by such means as reopening of proceedings at the origin of the violation, reversal of a judicial verdict, discontinuation of expulsion proceedings or, where necessary, payment of a monetary award to the applicant; but it must also take general measures to prevent the repetition of the violation. These latter measures may take the form, for example, of a change in legislation, recognition of the Court's judgment in national case-law, the appointment of extra judges or magistrates to absorb a backlog of cases, the construction of detention centres suitable for juvenile delinquents, the introduction of training for the police, or other similar steps. This second edition continues to examine both individual measures and general measures taken by states in accordance with the Court's judgments and with the supervisory proceedings of the Committee of Ministers, as published in its human rights (DH) resolutions.

On the one hand, its increasing importance is closely linked to institutional reforms that strengthened the European Court of Human Rights' reputation vis-a-vis the Member States. On the other hand, and even more importantly, the ECHR's significance arises from a changing perception of its constitutional potential. Starting with the assumption that the ECHR is transforming the European constitutional landscape, this book shows that the European Convention raises unprecedented problems that involve, first of all, its own theoretical status as constitutional instrument that ensures the protection of human rights in Europe. Changing paradigms concerning its incorporation in domestic law, as well as the growing conflicts about the protection of some rights and liberties that are deeply rooted in national legal contexts (such as teaching of religion, bio law, and rights of political minorities), are jointly examined in order to offer a unified methodology for the study of European constitutional law centered upon human rights. For a detailed analysis of these issues, the book examines the different facets of the ECHR's constitutional relevance by separating the ECHR's role as a 'factor of Europeanization' for national constitutional systems (Part I) from its role as a veritable European transnational constitution in the field of human rights (Part II). Considered the most forward looking regional agreement of the time, it influenced significantly the development of environmental law in Africa. Two and a half decades of intense developments in international environmental law made it necessary to revise this treaty, update its provisions and enlarge its scope. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.
