Tout d’abord, leur nombre ne cesse de croître dès lors que les objets interviennent de plus en plus dans le quotidien. Ensuite, du fait de la modernisation de la société, les choses sont plus sophistiquées, par suite sources de préjudices plus graves. Pour finir, la réparation de tels dommages suscite des difficultés pour le demandeur amené, dans un système juridique où la mise en jeu de la responsabilité exige la preuve d’une faute, à établir une intervention de l’objet derrière le fait d’un homme.Face à ces problèmes, juges et législateur sont intervenus en matière extra-contractuelle : le droit positif tient globalement compte des spécificités desdits préjudices. Toute autre est la situation dans le domaine contractuel. Ce dernier a connu de nombreuses et diverses évolutions. Pour autant, les particularités des dommages en question n’y sont pas considérées de façon globale, ce qui génère des différences de traitement entre victimes contractantes ; celles-là existent d’ailleurs aussi et par suite avec les victimes tiers. Un changement paraît alors nécessaire dans le second domaine, comme il l’est démontré dans cette thèse. Une proposition y est également exposée ; il s’agit de la création dans cette matière d’un principe général d’indemnisation des dommages causés par une chose, solution organisée autour de deux instruments juridiques : la mise en jeu d’une responsabilité contractuelle fondée sur un manquement à une obligation de sécurité de résultat et le recours à un fonds de garantie subsidiaire.

For long it was based on a mere five articles of the Civil Code of 1804, but on this foundation the courts and legal scholars have constructed liabilities for fault and strict liability of an extraordinary breadth and significance. While the rest of the general law of obligations (including contract) in the Civil Code was reformed in 2016 by executive ordonnance, this area was left aside, being the subject in 2017 of a proposal by the French Government for the legislative reform of the law of civil liability, a new legislative category to include both contractual and extra-contractual liability. This work considers important aspects of this developing area of French law in a series of essays by French lawyers and comparative lawyers working in French law and other civil law systems. Nor is it uncommon that, on the face of it, national private law creates rights and duties as well. In such situations of concurrence, the question that arises is whether the interested party may elect the rule of his choice. Is he entitled to choose the rule which appears to him to be the most advantageous? This book offers a scheme of analysis by which this question can be debated and solved.
