Book excerpt: La présente étude se propose d'éclairer le lecteur sur le rapport entre protection et autonomie de la personne mineure, non pas au travers des branches du Droit qui lui octroient des prérogatives, mais par le biais du Droit pénal qui limite leur exercice. Par essence la fragilité des mineurs conduit à une nécessaire protection de son corps, surtout par le Droit pénal, parfois contre la personne elle-même et conduisant à réduire ses libertés. Cependant, la minorité est évolutive et la protection spécifique doit s'atténuer au fur et à mesure que cette fragilité s'estompe pour céder le pas à l'autonomie. À l'image d'un curseur qui se déplace sur une ligne horizontale allant de la naissance à la majorité, c'est-à-dire de la protection à l'autonomie, il convient d'étudier l'adaptation du Droit durant la minorité et de rechercher le point d'équilibre entre la protection du corps de la personne mineure et l'autonomie de celle-ci sur son corps. Si la minorité est un état, celui-ci est temporaire et les règles de protection ont aussi pour but de conduire l'individu à la majorité et non de l'enfermer dans un état d'incapacité et d'immaturité pendant les dix-huit premières années de sa vie. A quel moment s'opère ce basculement entre protection et autonomie ? La multiplicité des situations où le mineur a acquis l'exercice de prérogatives sur son corps pose la question du maintien d'un principe général de protection. Les nombreuses exceptions ne justifient-elles pas la création d'un statut intermédiaire pendant la minorité qui permettrait d'identifier clairement le moment où la protection se doit de s'effacer devant l'autonomie ?

In the last 25 years since the Convention on the Rights of the Child was adopted, many States Parties to the Convention have made great efforts to pass legislation regulating the rights of the child, in their commitment to the improvement of the legal status of the child. However, is that enough for any child to live better, safer, and healthier? What are the practical effects of this international as well as many national instruments in the everyday life of children? Have there been any outcomes in terms of improvement of their status around the world, and improvement of the conditions under which they live, since the Convention entered into force? In tackling these questions, this work presents a comparative overview of the implementation of the Convention, and evaluates the results achieved.
