Se pose donc tout naturellement le problème de leur articulation. Certains objets de droit tels que les titres et les slogans, les créations multimédias, ou le logiciel, sont " complexes ". Plus généralement, ces droits de propriété intellectuelle sont souvent " concurrents ", que l'on songe ici à la concurrence entre le droit d'auteur et les droits voisins ou à celle entre le droit des marques et les autres signes distinctifs (appellations d'origine, indications géographiques, etc.). La première partie de l'ouvrage vise précisément à exposer les difficultés de l'articulation des droits de propriété intellectuelle en envisageant successivement les " objets complexes " et les " droits concurrents ". La seconde partie s'efforcera de rechercher des solutions. Faut-il ainsi élaguer, simplifier, c'est-à-dire supprimer certains droits de propriété intellectuelle encombrants ? La réponse sera ici donnée par un politique, impliqué dans la rédaction de lois récentes en matière de propriété intellectuelle, et un universitaire. Faut-il interpréter et si oui comment ? Les magistrats du fond, comme de la Cour de cassation, sont ici les mieux placés pour répondre. Faut-il hiérarchiser les droits comme le font les avocats? Ne pas réclamer, par exemple, la protection d'une oeuvre ou d'une marque jugée faible mais préférer agir sur le terrain de la concurrence déloyale ? C'est à cet ensemble de questions que répondent les différents contributeurs de cet ouvrage.

L’accord relatif aux aspects de droits de propriété intellectuelle qui touchent au commerce international, résultat des négociations du cycle d'Uruguay constitue sans conteste une amélioration du système conventionnel traditionnel. Il ne règle cependant pas tous les problèmes. L’organisation mondiale du commerce qui succède au GATT aura à faire face a un certain nombre de défis pour s'affirmer comme l'instance de régulation du commerce mondial.

Book excerpt: The joint challenges of population increase, food security and conservation of agrobiodiversity demand a rethink of plant breeding and agricultural research from a different perspective. While more food is undeniably needed, the key question is rather about how to produce it in a way that sustains biological diversity and mitigates climate change. This book shows how social sciences, and more especially law, can contribute towards reconfiguring current legal frameworks in order to achieving a better balance between the necessary requirements of agricultural innovation and the need for protection of agrobiodiversity. On the assumption that the concept of property can be rethought against the background of the 'right to include', so as to endow others with a common 'right to access' genetic resources, several international instruments and contractual arrangements drawn from the plant-breeding field (including the Convention on Biological Diversity, technology exchange clearing houses and open sources licenses) receive special consideration. In addition, the authors explore the tension between ownership and the free circulation and exchange of germplasm and issues such as genetic resources managed by local and indigenous communities, the ITPGRFA and participatory plant-breeding programmes. As a whole, the book demonstrates the relevance of the 'Commons' for plant breeding and agricultural innovation.
