Sa principale fonction est de favoriser autant que possible la bonne marche, la prévisibilité et la liberté des échanges. » Il ressort de cette véritable déclaration de foi prononcée par l'institution de l'OMC elle-même, que celle-ci s'est donnée prioritairement pour but de réguler le commerce mondial en en fixant les règles tout en favorisant la « bonne marche, la prévisibilité et la liberté des échanges. » Or, comme nous le verrons dans cet ouvrage, loin d'être parfaite, l'institution de l'OMC présente de nombreuses lacunes et faiblesses, dont la principale reste l'absence d'exécution de ses propres décisions rendues par son organe juridictionnel, à savoir l'Organe de Règlement des Différends (ORD). L'auteur démontre, à travers l'étude du contentieux des subventions à l'exportation (sociétés de vente à l'étranger) et l'analyse de deux affaires commerciales qui ont défrayé la chronique jurisprudentielle de l'OMC (Airbus contre Boeing et Boeing contre Airbus), tant par leur durée que par leur absence de dénouement, que l'institution gendarme du commerce mondial s'avère bien souvent impuissante à résoudre certains contentieux présentés devant elle par des États Membres.
