Cette approche donne une vision à la fois riche et réaliste de la situation du droit du travail de l’Union, qui, en dépit d’une certaine autonomie, se développe dans un jeu d’interactions avec d’autres droits auxquels il emprunte, ou dont il se distingue, qui le complètent ou, au contraire, en limitent le déploiement. L’ouvrage commence par expliquer les remises en cause que le développement du droit de l’Union a imposé, dans la sphère des politiques sociales nationales. Le droit « du travail » de l’Union est, à cet égard, un droit qui affecte les rapports de travail, régis par les droits du travail nationaux, non un droit conçu pour protéger les travailleurs ou assurer les conditions d’une juste concurrence entre les entreprises. Cette deuxième dimension du « droit du travail de l’Union européenne » n’est pas, pour autant, négligeable. Depuis les années 1970, ce droit s’est considérablement développé, dans certains domaines autrefois seulement occupés par les droits nationaux et, dans une moindre mesure, par le droit international du travail. L’ouvrage illustre cette montée en puissance, et le rôle essentiel désormais tenu par le droit de l’Union dans certains segments du droit du travail. Il montre aussi le caractère parcellaire de ces développements, l’absence de couverture systématique des différents domaines, les manques. Pour combler les vides, il arrive que le droit international du travail, issu, notamment, de la CEDH ou des conventions de l’OIT soit invoqué. La dernière partie de l’ouvrage est consacrée au jeu de convergences, aux possibles complémentarités du droit de l’Union européenne et du droit international du travail, au sens large, pour en montrer l’importance, au-delà des aspects les plus apparents.

Book excerpt: Even though the policy impact of Catholicism has increasingly been acknowledged, existing scholarship lacks a coherent view on its changing influence over time and in different political contexts. In this book, Fabio Bolzonar investigates the influence of Catholicism on developments in French social protection from World War II to the mid-2010s. He discusses the factors that have favoured or inhibited it and explores the hybridization between Catholic values and secular principles in the social engagement of Catholic actors in secular France. By doing so, this multidisciplinary study integrates current scholarship, which has given limited attention to the changing patterns of Catholic involvement in the social policy domain over a long period of time, and the renewed influence of Catholic values in secularized societies. Catholic mobilization has relocated from the political to the civil society sphere, making voluntary organizations and social movements, rather than political parties, the main channels for defending Catholic values in secular France. Rather than marginalizing Catholicism, this process has opened up new opportunities for Catholic actors and values to play a significant role in society and politics. Bolzonar identifies two divergent scenarios that define Catholic social engagement in contemporary France: either the strengthening of new forms of institutional collaboration between Catholic-inspired philanthropic organizations and public administrations in the interest of socially vulnerable citizens, or the emergence of new ideological conflicts on gender- and sexuality-related issues.

Book excerpt: The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.

The motive for founding the Academy was to promote associating and confronting on an international background the scientific research work produced in the various domains dealing with the Legal and Social Medicine. As first presi dent of the International Academy of Legal Medicine and Social Medicine, Professor Knud Sand from Copenhagen, assisted by colleagues of the Praesidium appointed as national representatives, succeeded in gathering together nearly the whole aca demic people involved in Legal and Social Medicine. Thus one year later, in 1939, The Academy became a worldwide institution of 450 members from thirty nations. After the war, what had been before of considerable interest for the progress of the knowledge and techniques in Legal Medicine remained again a pressing necessity leading to the second meeting of the Academy in 1947 in Brussels under the presi dency of Professor De Laet. Since then the meetings of the Academy followed one another every three years. At this point, I would like to thank all the past presidents of the Academy and in particular Professor Roche and Professor Andre for their contribution without which the Academy would not be what it is presently.
