EXTRAIT La loi Macron du 6 août 2015 a allongé la durée du délai de rétractation et du délai de réflexion qui est désormais de 10 jours. Par ailleurs, elle a clarifié les choses en précisant que « les contrats immobiliers conclus hors établissement ne sont plus dans le champ d’application de la loi Hamon » qui prévoyait un délai de 14 jours. Pour tous ces contrats, le délai de rétractation est désormais de 10 jours. Le délai de 10 jours court à compter du lendemain de la notification de l’acte par LRAR ou le lendemain de la remise en main propre de l’acte. Ce délai expire le 10e jour à minuit, s’il s’agit d’un dimanche ou jour férié, il est reporté au jour ouvrable suivant. Les règles de calcul des délais sont prévues aux articles 641 et suivants du code de procédure civile. La faculté de rétractation n’a pas à être motivée, elle s’exerce par LRAR. Elle entraîne la résolution rétroactive de l’acte. Le dépôt de garantie devra être restitué à l’acquéreur sous 21 jours à compter du lendemain de la date de cette rétractation.
