Book excerpt: L'analyse des transferts hydriques inter-bassins massifs a fait l'objet de très peu de travaux en économie. Pourtant ce type d'intervention hydraulique est amené à prendre une place croissante dans la gestion de l'eau au 21ème siècle, dans les pays en développement et émergents notamment. Nous proposons une analyse du point de vue de l'économie écologique d'un projet de transfert hydrique dans le Nordeste du Brésil, en nous penchant particulièrement sur les conflits socio-environnementaux qui ont lieu autour de ce mégaprojet. Dans un premier temps, nous caractérisons le style de développement économique adopté par le Brésil au tournant du siècle ainsi que la dynamique des réformes de la gestion de l'eau. Nous tirons de cette analyse une présentation stylisée du complexe eau-économie nécessaire à la compréhension du projet étudié. Nous discutons ensuite les apports et limites des approches économiques (économie du bien-être, économie de la soutenabilité) de l'évaluation des grands projets hydrauliques. Nous mettons en exergue la spécificité des transferts inter-bassins massifs et proposons une grille d'analyse économique adaptée. Dans une troisième partie, nous approfondissons les conflits socio-environnementaux qui ont eu lieu autour du projet de transfert. Nous proposons une analyse en termes de justice environnementale ainsi qu'une modélisation de type institutionnaliste du conflit et de ses répercussions.

Pas moins de neuf transferts d'eau majeurs détournent 3,5 km d'eau par an constituant un véritable réseau national maillé de transferts d'eau. Cette thèse montre que la construction de ce système a toujours été très discuté et ne correspond pas à une logique « hydraulique », mais bien à des objectifs politiques ou géopolitiques. Ces ouvrages ne sont pas les seuls aménagements à avoir un impact sur les principaux paramètres de l'hydrosystème : de très nombreux ouvrages plus modestes ont été construits depuis plus d'un siècle. La critique des grands transferts doit donc toujours prendre en compte les synergies d'impacts pour prévoir des mesures de mitigation efficaces. De même, seule une compréhension des évolutions locales fait apparaître les modifications induites par le transfert sur les régions concernées. Les transferts étudiés ont un point commun : la modification irréversible des échelles de gestion de l'hydrosystème, induite par la rupture du cadre du bassin versant. Cela explique pourquoi il est si difficile pour l'Afrique du Sud postapartheid de «sortir » de ce mode de développement.

Book excerpt: This book represents a first attempt to investigate the relations between Law and Agroecology. There is a need to adopt a transdisciplinary approach to multifunctional agriculture in order to integrate the agroecological paradigm in legal regulation. This does not require a super-law that hierarchically purports to incorporate and supplant the existing legal fields; rather, it calls for the creation of a trans-law that progressively works to coordinate interlegalities between different legal fields, respecting their autonomy but emphasizing their common historical roots in rus in the process. Rus, the rural phenomenon as a whole, reflects the plurality and interdependence of different complex systems based jointly on the land as a central point of reference. “Rural” is more than “agricultural”: if agriculture is understood traditionally as an activity aimed at exploiting the land for the production of material goods for use, consumption and private exchange, rurality marks the reintegration of agriculture into a broader sphere, one that is not only economic, but also social and cultural; not only material, but also ideal, relational, historical, and symbolic; and not only private, but also public. In approaching rus, the natural and social sciences first became specialized, multiplied, and compartmentalized in a plurality of first-order disciplines; later, they began a process of integration into Agroecology as a second-order, multi-perspective and shared research platform. Today, Agroecology is a transdiscipline that integrates other fields of knowledge into the concept of agroecosystems viewed as socio-ecological systems. However, the law seems to still be stuck in the first stage. Following a reductionist approach, law has deconstructed and shattered the universe of rus into countless, disjointed legal elementary particles, multiplying the planes of analysis and, in particular, keeping Agricultural Law and Environmental Law two separate fields.
