Book excerpt: Les états membres des nations unies ont élaboré un corpus juridique destiné à protéger et à améliorer la condition de l’enfant dans les conflits armés. L’idée principale de cette protection est que l’enfant est un être particulièrement vulnérable. Dès lors, lorsqu’il ne participe pas aux hostilités, il ne doit pas être pris pour cible dans les attaques, encore moins recruté par les belligérants. En tant que membre de la population civile, il bénéficie d’une protection générale contre les attaques et d’une protection spéciale essentiellement conçue en vue d’assurer ses besoins essentiels et le protéger contre les effets des hostilités. Nonobstant cette dernière mesure, il est souvent contraint de fuir en tant que réfugié ou déplacé à l’intérieur de son pays. En fait l’enfant peut se retrouver comme soldat au sein des forces et groupes armés. Pour cette raison la communauté internationale a réglementé son recrutement et sa participation aux hostilités. Ceux-ci commettent les pires atrocités de guerre. Face à cette situation, comment le droit international appréhende-t-il l’identité des enfants soldats ? s’agit-il de bourreaux et/ou de victimes ? Cette étude tente de démontrer que le corpus juridique élaboré par la communauté internationale protège efficacement l’enfant dans les conflits armés. Seulement cette protection serait effective si ces normes étaient respectées par les belligérants

Book excerpt: Avant les Conventions de Genève de 1949, seuls les conflits armés internationaux étaient réglementés par le droit de la guerre. Ce dernier ne pouvait s’appliquer dans les guerres civiles qu’après la reconnaissance des forces rebelles comme partie belligérante. Or, depuis la Seconde guerre mondiale, on a assisté à une multiplication des conflits armés non internationaux. Mais les Conventions de Genève de 1949 leur ont consacré seulement l’article 3 commun ; puis le Protocole II additionnel de 1977 est venu le compléter. Ces deux textes comportent de nombreuses lacunes, notamment l’absence de définition des « combattants » et des « civils », rendant ainsi difficile le respect du principe de distinction pourtant essentiel à la protection des populations civiles. Ces dispositions ne réglementent pas non plus les moyens et méthodes de guerre. Outre les lacunes normatives, il y a des problèmes matériels qui compliquent la mise en œuvre efficace des règles pertinentes. Il s’agit notamment de la participation des populations civiles aux hostilités, y compris les enfants-soldats et les mercenaires. L’absence du statut de combattant dans les conflits armés non internationaux apparaît comme le problème principal compromettant l’efficacité du droit international humanitaire. Celle-ci ne contribue-t-elle pas au non-respect de ce droit par les groupes armés ? Faudrait-il conférer ce statut à ces derniers en vue de les amener à appliquer le droit international humanitaire ou envisager d’autres moyens ? Toutes ces questions sont traitées. L’ouvrage intéressera les praticiens spécialisés en droit humanitaire, en droit de l’homme, en droit international public et en droit pénal international mais aussi les professeurs et les étudiants.

The purpose of this book is to address the fuzzy areas between Us and Them through the study of European belonging as it is represented in the French elite daily, Le Monde. Corpora collected from 2014 to 2017 are used for case studies in the framework of Discourse Analysis to look at the use of “Europe” in headlines, and the representation of the United Kingdom, Poland, Hungary, Romania, Ukraine, Belarus, and Turkey. The combination of these case studies allows to present a conceptual framework for the representation of Europe by Le Monde. However, beyond the study of what belonging to Europe means for Le Monde, this book is about the legitimacy of being “in-between”, i.e. belonging neither totally to Us nor to Them.

Available in PDF, EPUB and Kindle. Book excerpt: Unlike many other countries, the United States has few constitutional guarantees of social welfare rights such as income, housing, or healthcare. In part this is because many Americans believe that the courts cannot possibly enforce such guarantees. However, recent innovations in constitutional design in other countries suggest that such rights can be judicially enforced--not by increasing the power of the courts but by decreasing it. In Weak Courts, Strong Rights, Mark Tushnet uses a comparative legal perspective to show how creating weaker forms of judicial review may actually allow for stronger social welfare rights under American constitutional law. Under "strong-form" judicial review, as in the United States, judicial interpretations of the constitution are binding on other branches of government. In contrast, "weak-form" review allows the legislature and executive to reject constitutional rulings by the judiciary--as long as they do so publicly. Tushnet describes how weak-form review works in Great Britain and Canada and discusses the extent to which legislatures can be expected to enforce constitutional norms on their own. With that background, he turns to social welfare rights, explaining the connection between the "state action" or "horizontal effect" doctrine and the enforcement of social welfare rights. Tushnet then draws together the analysis of weak-form review and that of social welfare rights, explaining how weak-form review could be used to enforce those rights. He demonstrates that there is a clear judicial path--not an insurmountable judicial hurdle--to better enforcement of constitutional social welfare rights.
