Celle-ci permet d'abandonner la classique négociation d'addition, au profit d'une négociation de substitution, qui concilie aspirations sociales et contraintes économiques. Les employeurs et les acteurs sociaux n'ont, que très rarement, pris toute la mesure de cette physionomie nouvelle du droit, en raison à la fois de blocages psychologiques, et de la méconnaissance de la réglementation. Le présent ouvrage, conçu par un juriste, organisateur familier de la négociation collective, s'assigne comme objectif de mettre en évidence ce visage nouveau de la législation en ce domaine. D'une part, il traite successivement des aspects quantitatifs (durée effective) et qualitatifs (aménagements des temps de travail) de la durée du travail, puis du repos hebdomadaire et de la fermeture du dimanche, enfin du repos et de l'indemnisation des jours fériés. D'autre part, il fixe les règles, le contenu, et les limites de la politique contractuelle en ces matières, donnant ainsi l'approche dynamique que requiert le sujet pour la gestion des temps de travail.
