Cette étude tente de souligner une évolution dans les fondements et les modalités selon lesquels le droit attache des conséquences juridiques à une situation de dénuement matériel.La formulation traditionnelle de la pauvreté en terme de "question sociale" exprime l'angoisse de dislocation née des désordres sociaux engendrés par la pauvreté. Ramener l'ordre et affermir la cohésion menacée, tel était le fondement traditionnel de la prise en compte de la pauvreté: historiquement, ce souci de cohésion se traduisait par l'affirmation d'un devoir d'assistance, justifié par des considérations à la fois morales et d'ordre public lato sensu, les mesures juridiques adoptées révélant ce diptyque d'assistance et de méfiance. Depuis 1946, le souci de cohésion sociale est intrinsèquement lié aux principes d'égalité et de solidarité qui fondent l'organisation sociale. L'ordre juridique traduit cette recherche de cohésion: structuré autour du travail et de la satisfaction du besoin via des dispositions diverses et parcellaires, le droit ne se saisit de la pauvreté que de façon latérale, lorsque sa manifestation extrême, le vagabondage et la mendicité, menace la cohésion recher059885688chée. Les années 1980-1990 révèlent une évolution sensible. Le recentrage autour de l'individu entraîne la découverte par le droit du phénomène de l'exclusion sociale et sa formulation en termes juridiques. Cette découverte prend sa source dans une nouvelle lecture de la pauvreté en terme de droits de l'homme: l'affirmation de droits sociaux et la prise de conscience d'une violation des droits fondamentaux due à la pauvreté. Le changement de perspective, orienté vers la protection des droits de l'individu et de sa dignité, constitue les prémisses d'une évolution récente, caractérisée par la proclamation d'un droit à l'insertion en réponse à la découverte de l'exclusion sociale et le remodelage de l'ordre juridique autour de cette notion éclairante.
