Book excerpt: Peu fréquemment étudiée par la doctrine qui préfère s'étendre sur les caractéristiques du recours pour excès de pouvoir ou sur l'évolution des règles de fond du droit de la responsabilité, l'action en responsabilité extra-contractuelle présente, néanmoins, des aspects fort singuliers et soulève maintes questions pour le moins intéressantes. Ses particularités proviennent de l'interaction entre le droit subjectif du demandeur et les pouvoirs qui lui sont attachés, d'une part, et les spécificités du contentieux administratif et du droit de la responsabilité administrative, d'autre part. De cette interaction résultera un " dosage " de contraintes et de libertés imprégnant à la fois l'office du juge et les règles de l'action. Que la sauvegarde des deniers publics s'impose et la proportion de contraintes augmentera ; que les droits du requérant soient mis en péril et le juge interviendra pour assouplir les exigences procédurales ou permettre la régularisation de la requête. L'examen de ce " dosage ", à travers tant les règles de procédure propres à l'action en responsabilité que l'office du juge, permet d'évaluer l'équilibre entre les parties à l'instance, de mettre l'accent sur l'existence d'une logique procédurale spécifique à l'action en responsabilité et, fondamentalement, de se pencher, au sein du contentieux administratif, sur les rapports entre le droit subjectif et l'action. L'action en responsabilité serait-elle - comme semble le soutenir la doctrine dans son écrasante majorité - l'attribut d'un droit ? Ou bien suffit-il d'un intérêt juridiquement protégé ? Que faut-il entendre par le mot " droit " dans l'adage " pas de droit, pas d'action " ? Est-ce le droit lésé ou un droit d'une nature autre ?

C’est ainsi que les justiciables pourront solliciter la remise en cause de la chose décidée, voire de la chose jugée ou encore, chercher à engager la responsabilité «judiciaire» de l’État. On pressent pourtant que les solutions, très restrictives, forgées par la Cour de justice sont supplantées par les dispositifs nationaux. Ceux-ci paraissent en effet plus aisés à actionner, voire plus performants, qu’il s’agisse de la violation du droit au juge légal, comme en Allemagne ou en Espagne, ou encore de l’introduction du dispositif législatif suédois. La présentation – sans égal à ce jour – de près de vingt rapports nationaux permettra de mieux apprécier l’effectivité de la protection juridictionnelle dont disposent les justiciables via le renvoi préjudiciel. L’intérêt de cet ouvrage est d’autant plus vif que l’adhésion prochaine de l’Union européenne à la Convention européenne des droits de l’homme se traduira vraisemblablement par une revitalisation des dispositions permettant de sanctionner une violation de l’obligation de renvoi préjudiciel. Cet ouvrage s’adresse principalement aux magistrats et aux avocats, ainsi qu’aux universitaires spécialisés dans l’étude du droit processuel.

Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.
