Book excerpt: Faire société nécessite le développement de politiques d’inclusion dont celles en direction des travailleurs handicapés. Leur intégration socioprofessionnelle qui se réfère au principe de non-discrimination, reste faible depuis des années. La question initiale s’attache à en comprendre les causes. Cette thèse s’articule autour de trois hypothèses. La première examine si des idéaux types sous-jacents aux textes et aux pratiques ne traduisent pas une certaine hésitation sur la place des personnes handicapées dans la société. La deuxième recherche si des inégalités de statut d’allocataires ou certaines caractéristiques de leurs bénéficiaires ne pouvaient aider à comprendre une part de leur exclusion. La troisième hypothèse concerne la posture de la personne handicapée qui, poussée à s’intégrer, mais dans un monde de normes de plus en plus exigeantes, chercherait à utiliser au mieux le dispositif existant. À l’issue d’une dernière partie de discussion, il est apparu nécessaire que les personnes les plus en limite d’intégration puissent bénéficier du choix de travailler et de vivre en milieu ordinaire grâce à des dispositifs adaptés et être financièrement garantis quels que soient leurs choix.

Ce texte fondateur, qui s’inscrit dans la philosophie juridique de la Convention internationale relative aux droits des personnes handicapées, organise la compensation des situations de handicap. Cette compensation comporte deux versants?: l’un sociétal se basant sur la pratique du droit, l’autre social trouvant sa source dans le droit positif. Les bouleversements qu’impliquent l’inclusion appellent une formation à la culture de l’accessibilité. Le Défenseur des droits a souhaité accompagner une réflexion des professionnels de la justice afin de produire un socle commun de connaissances permettant la mise en œuvre effective de l’inclusion. Cette démarche a été pilotée par l’association Droit Pluriel et a abouti à la création d’une mallette pédagogique «?Professionnels du droit et handicap?», constituée de ce manuel ainsi que d’un guide pratique et de trois courts-métrages. Cet ouvrage offre à tous les aspirants et professionnels du droit les clefs d’une justice accessible. Kim-Khanh Pham est doctorant en droit public à l’Université Paris II Panthéon-Assas. Sa thèse traite de l’inclusion en droit public des personnes en situation de handicap. Anne-Sarah Kertudo est engagée dans l’accès au droit des personnes en situation de handicap depuis 20 ans. Elle est aujourd’hui directrice de l’association Droit Pluriel.

The study seeks first to enhance knowledge about the current state of existing social safety nets (SSNs) in the Middle East and North Africa, assessing their effectiveness by bringing together new evidence, data, and country-specific analysis. Second, it proposes an open and informed debate on feasible policy options for making SSNs more effective and responsive to the population's needs. In order to do this, the authors illustrate how the main goals for SSNs-promoting social inclusion, better livelihood, and resilience to shocks-have already been achieved in some parts of the region, notwithstanding huge challenges. They also identify the groups that regional SSNs should make a priority: children and people living in rural and lagging areas. The study relies on newly collected data on citizens' preferences concerning redistribution and SSN design, discussing how political economy considerations could be taken into account in designing better SSNs, and proposing an agenda for reform, using global experiences and the new evidence presented in the book itself.
