Kauikeaouli (Kamehameha III) agreed to the Mahele, which divided all land among the mō‘ī (king), the ali‘i (chiefs), and the maka‘āinana (commoners), in the hopes of keeping the lands in Hawaiian hands even if a foreign power claimed sovereignty over the Islands. The king’s share was further divided into Government and Crown Lands, the latter managed personally by the ruler until a court decision in 1864 and a statute passed in 1865 declared that they could no longer be bought or sold by the mō‘ī and should be maintained intact for future monarchs. After the illegal overthrow of the monarchy in 1893, Government and Crown Lands were joined together, and after annexation in 1898 they were managed as a public trust by the United States. At statehood in 1959, all but 373,720 acres of Government and Crown Lands were transferred to the State of Hawai‘i. The legal status of Crown Lands remains controversial and misunderstood to this day. In this engrossing work, Jon Van Dyke describes and analyzes in detail the complex cultural and legal history of Hawai‘i’s Crown Lands. He argues that these lands must be examined as a separate entity and their unique status recognized. Government Lands were created to provide for the needs of the general population; Crown Lands were part of the personal domain of Kamehameha III and evolved into a resource designed to support the mō‘ī, who in turn supported the Native Hawaiian people. Book excerpt: Leveraging Sovereignty: Kauikeaouli’s Global Strategy for the Hawaiian Nation, 1825–1854 examines the leadership of Hawai‘i’s longest reigning monarch, King Kamehameha III. It highlights the early 1840s, when Kauikeaouli secured recognition from the United States, Britain, and France that he ruled over an independent and sovereign Hawaiian state. Britain and France, however, sought to limit his powers through forced extraterritorial treaties, and the king struggled to regain ruling control over key governance functions. At the same time, foreign merchants and traders increasingly dominated Hawai‘i’s economic activity, demanded institutional and social changes, and threatened to overwhelm the Hawaiian population already decimated by disease and out-migration. Kauikeaouli quickly responded to threats to the monarchy’s power with a comprehensive strategy to regain and maintain full functional control. In Leveraging Sovereignty, J. Susan Corley upends the popular narrative begun in Kauikeaouli’s own lifetime that his white ministers ruled in his stead. Adding a new layer of understanding, Corley’s meticulous research reveals insights into historical events and Kauikeaouli’s reign. She supports her findings of the king’s policies and tactical negotiations with an extensive use of Kamehameha III’s own commands as recorded in kingdom archives, letters and documents from government records, and contemporary Hawaiian- and English-language newspaper accounts. While this book includes an overview of the kingdom’s administrative structure in the 1840s, its analysis focuses on the origination, implementation, and effectiveness of key statecraft tactics. The king’s carefully planned strategy relied on the acquisition of western ministerial skills and of an English-language newspaper (the Polynesian) to publicly defend his sovereign rights and privileges at home and abroad. He ensured the enactment of legislation to defeat foreigners’ challenges by strengthening juridical processes and safeguarding land-title rights for Hawaiians, and he deftly managed the multistage renegotiation of unequal international treaties. By the end of his reign in 1854, Kamehameha III had succeeded: The king had reclaimed unrestricted power and authority over all governance areas of the independent, sovereign Hawaiian state. He delivered to his successor Kamehameha IV a restructured, constitutional state whose sovereign status was protected by the three maritime powers of that time.

Many tourists—and residents—however, are unaware that the statue is a replica; the original, cast in Paris in the 1880s and the first statue in the Islands, stands before the old courthouse in rural Kapa‘au, North Kohala, the legendary birthplace of Kamehameha I. In 1996 conservator Glenn Wharton was sent by public arts administrators to assess the statue’s condition, and what he found startled him: A larger-than-life brass figure painted over in brown, black, and yellow with “white toenails and fingernails and penetrating black eyes with small white brush strokes for highlights. . . . It looked more like a piece of folk art than a nineteenth-century heroic monument.” The Painted King is Wharton’s account of his efforts to conserve the Kohala Kamehameha statue, but it is also the story of his journey to understand the statue’s meaning for the residents of Kapa‘au. He learns that the townspeople prefer the “more human” (painted) Kamehameha, regaling him with a parade, chants, and leis every Kamehameha Day (June 11). He meets a North Kohala volunteer who decides to paint the statue’s sash after respectfully consulting with kahuna (Hawaiian spiritual leaders) and the statue itself. A veteran of public art conservation, Wharton had never before encountered a community that had developed such a lengthy, personal relationship with a civic monument. Going against the advice of some of his peers and ignoring warnings about “going native,” Wharton decides to involve the people of Kapa‘au in the conservation of their statue and soon finds himself immersed in complex political, social, and cultural considerations, including questions about representations of the Native Hawaiian past: Who should decide what is represented and how? And once a painting or sculpture exists, how should it be conserved? The Painted King examines professional authority and community involvement while providing a highly engaging and accessible look at “activist conservation” at work, wherever it may be found.
