But unknown to the world, on that very day, the quiet-spoken mathematics teacher and aspirant priest turned reluctant revolutionary had also set up a secret think tank in Lusaka, which he named the Constitution Committee, giving it an ‘ad hoc unique exercise’ that had ‘no precedent in the history of the movement’. Joe Johnston (1890-1972), from a Tyrone Presbyterian small-farm background, had 3 elder brothers who made their careers in the Indian Civil Service. The family were 'Home Rule within the Empire' supporters in the Ulster liberal tradition. After studying classics and ancient history in Trinity College Dublin (TCD) and then in Oxford, JJ became a Fellow of Trinity in 1913. He then published his anti-Carson book Civil War in Ulster, attacking the process which culminated in the 1914 Larne gun-running. He contributed significantly to the emergent national movement. He wrote critically about 1930s economic policies, and went on the serve in the Irish Senate/Sennad from 1939 to 1954. His son RJ (b.1929) was a pioneer of the student left in TCD in the 1940s, and was associated with the post-war attempt to bring European Marxist thinking into the Irish labour movement, with the foundation of the Irish Workers League in 1948. After a period in London in the early 1960s, he returned to Dublin, this time as a research scientist, and helped Cathal Goulding in his attempt to get the 1960s generation of republicans to go political, in a democratic left-wing mode, decoupling from the Stalinist incubus. He helped set the stage for the emergence of the Civil Rights approach to reform in Northern politics, as a means of opening up an all-Ireland perspective. His opponents in the Republican movement, the Provisionals, opted for violence . In the ensuing decades he participated in various politicising processes which may, in the end, show the counter-productive nature of the role of the gun in politics, in Ireland and elsewhere. Book excerpt: Under its first chief justice, Arthur Chaskalson, the South African Constitutional Court built an unrivalled reputation in the comparative constitutional law community for technically accomplished and morally enlightened decision-making. At the same time, the Court proved remarkably effective in asserting its institutional role in post-apartheid politics. While each of these accomplishments is noteworthy in its own right, the Court's simultaneous success in legal and political terms demands separate investigation. Drawing on and synthesising various insights from judicial politics and legal theory, this study offers an interdisciplinary explanation for the Chaskalson Court's achievement. Rather than a purely political strategy of the kind modelled by rational choice theorists, the study argues that the Court's achievement is attributable to a series of adjudicative strategies in different areas of law. In combination, these strategies allowed the Court to satisfy institutional norms of public reason-giving while at the same time avoiding political attack.

Book excerpt: Adam Sitze meticulously traces the origins of South Africa’s Truth and Reconciliation Commission back to two well-established instruments of colonial and imperial governance: the jurisprudence of indemnity and the commission of inquiry. This genealogy provides a fresh, though counterintuitive, understanding of the TRC’s legal, political, and cultural importance. The TRC’s genius, Sitze contends, is not the substitution of “forgiving” restorative justice for “strict” legal justice but rather the innovative adaptation of colonial law, sovereignty, and government. However, this approach also contains a potential liability: if the TRC’s origins are forgotten, the very enterprise intended to overturn the jurisprudence of colonial rule may perpetuate it. In sum, Sitze proposes a provocative new means by which South Africa’s Truth and Reconciliation Commission should be understood and evaluated.
