Book excerpt: Conferencing and cautioning are used as diversionary alternatives in the juvenile justice system and there is evidence to suggest they reduce reoffending. As Indigenous young people are overrepresented in the juvenile justice system, an important question is whether they are as likely to be diverted as non-Indigenous young people. This study used modelled data to examine juveniles' contact with the police and courts, and the differences in juvenile diversionary rates for Indigenous and non-Indigenous offenders in New South Wales, South Australia and Western Australia in 2005. For all states, Indigenous young offenders were more likely than non-Indigenous offenders to be referred to court, non-Indigenous offenders were more likely to receive a police caution, and males and older offenders were more likely to be diverted. The number of prior contacts was similar for all states, with more contacts reducing the likelihood of diversion and with less likelihood of diversion for offenders committing offences against a person. As Indigenous young offenders are more likely to have multiple prior contacts with the system, including detention, further research is needed into the reasons for their high reoffending rates.

This exceptional book is based upon a major Australian research programme to consider the key social factors impacting upon the lives of young people. A sample of 1,300 young people was divided into three major subgroups: a 'control' group, drawn from state secondary schools and closely approximating the general population; a chronically marginalized cohort representing a 'vulnerable group', and a group of offenders, most of whom were incarcerated at the time of the research. With its rich data source and highly integrated structure, the book makes a major contribution to our understanding of adolescent criminality and associated policy both in Australia and internationally.

Book excerpt: The historical context of colonisation situates the analysis in Children, Care and Crime of the involvement of children with care experience in the criminal justice system in an Australian jurisdiction (New South Wales), focusing on residential care, policing, the provision of legal services and interactions in the Children’s Court. While the majority of children in care do not have contact with the criminal justice system, this book explores why those with care experience, and Indigenous children, are over-represented in this system. Drawing on findings from an innovative, mixed-method study – court observations, file reviews and qualitative interviews – the book investigates historical and contemporary processes of colonisation and criminalisation. The book outlines the impact of trauma and responses to trauma, including inter-generational trauma caused by policies of colonisation and criminalisation. It then follows a child’s journey through the continuum of care to the criminal justice system, examining data at each stage including the residential care environment, interactions with police, the provision of legal services and experiences at the Children’s Court. Drawing together an analysis of the gendered and racialised treatment of women and girls with care experience in the criminal justice system, the book particularly focuses on legacies of forced removal and apprenticeship which targeted Aboriginal and Torres Strait Islander women and girls. Through analysing what practices from England and Wales might offer the NSW context, our findings are enriched by further reflection on how decriminalisation pathways might be imagined. While there have been many policy initiatives developed to address criminalisation, in all parts of the study little evidence was found of implementation and impact. To conclude, the book examines the way that ‘hope tropes’ are regularly deployed in child protection and criminal justice to dangle the prospect of reform, and even to produce pockets of success, only to be whittled away by well-worn pathways to routine criminalisation. The conclusion also considers what a transformative agenda would look like and how monitoring and accountability mechanisms are key to new ways of operating. Finally, the book explores strengths-based approaches and how they might take shape in the child protection and criminal justice systems. Children, Care and Crime is aimed at researchers, lawyers and criminal justice practitioners, police, Judges and Magistrates, policy-makers and those working in child protection, the criminal justice system or delivering services to children or adults with care experience. The research is multidisciplinary and therefore will be of broad appeal to the criminology, law, psychology, sociology and social work disciplines. Book excerpt: The Australian Government has provided funding to evaluate the effectiveness of Indigenous law and justice programs across five subject areas to identify the best approaches to tackling crime and justice issues and better inform government funding decisions in the future. This report presents the findings of subject area "C", 'Diversion programs'. It examined the impact of four programs designed to divert Indigenous people from entering the justice system. The four programs sit at different points along a continuum, ranging from prevention (addressing known risk factors for offending behaviour), early intervention (with identified at-risk young people), diversion (diverting from court process - usually for first or second time offenders), and tertiary intervention (treatment to prevent recidivism). The programs evaluated were: Aboriginal Power Cup, a sports-based prevention program in South Australia; Tiwi Islands Youth Development and Diversion Unit, an early intervention and diversion program that engages Tiwi youth who are at-risk of entering the criminal justice system in prevention activities; Woorabinda Early Intervention Panel Coordination Service, an assessment and referral program for early intervention and diversion, in Queensland; and Aggression Replacement Training, a group cognitive-behavioural program for youth assessed as at risk of offending or re-offending, also in Queensland.
