Book excerpt: Using Texas as a case study for understanding change in the American juvenile justice system over the past century, the author tells the story of three cycles of scandal, reform, and retrenchment, each of which played out in ways that tended to extend the privileges of a protected childhood to white middle- and upper-class youth, while denying those protections to blacks, Latinos, and poor whites. On the forefront of both progressive and "get tough" reform campaigns, Texas has led national policy shifts in the treatment of delinquent youth to a surprising degree. Changes in the legal system have included the development of courts devoted exclusively to young offenders, the expanded legal application of psychological expertise, and the rise of the children's rights movement. At the same time, broader cultural ideas about adolescence have also changed. Yet the author demonstrates that as the notion of the teenager gained currency after World War II, white, middle-class teen criminals were increasingly depicted as suffering from curable emotional disorders even as the rate of incarceration rose sharply for black, Latino, and poor teens. He argues that despite the struggles of reformers, child advocates, parents, and youths themselves to make juvenile justice live up to its ideal of offering young people a second chance, the story of twentieth-century juvenile justice in large part boils down to the exclusion of poor and nonwhite youth from modern categories of childhood and adolescence.

Book excerpt: One of the key premises for creating a separate criminal justice system for juveniles was that juveniles were not the same as adults, and could therefore be rehabilitated. Despite this premise, still largely held today, the rate of recidivism for juveniles is dismal. The history of a supposedly rehabilitative juvenile justice system in the United States is a failed history of incarceration, much like that of adult corrections. Rehabilitation by incarceration has proved to be an ineffective and unsustainable strategy. A robust amount of research shows that treating juveniles closer to home, in fact in their communities, is the most effective tool for rehabilitating juvenile offenders. This book not only makes an argument for juvenile justice within a young person’s community; it provides a model. From the beginning, Tarrant County Juvenile Services has been an exception to the national norm. The state of Texas deals with some of its most serious and violent youthful offenders through “determinate sentencing,” a unique sentencing structure that blends parts of the juvenile and adult justice systems. Once adjudicated via determinate sentencing, offenders are first incarcerated in the Texas Youth Commission (TYC). As they approach age eighteen, they are either transferred to the Texas prison system to serve the remainder of their original determinate sentence or released from TYC into Texas’s communities. The first long-term study of determinate sentencing in Texas, Lost Causes examines the social and delinquent histories, institutionalization experiences, and release and recidivism outcomes of more than 3,000 serious and violent juvenile offenders who received such sentences between 1987 and 2011. The authors seek to understand the process, outcomes, and consequences of determinate sentencing, which gave serious and violent juvenile offenders one more chance to redeem themselves or to solidify their place as the next generation of adult prisoners in Texas. The book’s findings—that about 70 percent of offenders are released to the community during their most crime-prone years instead of being transferred to the Texas prison system and that about half of those released continue to reoffend for serious crimes—make Lost Causes crucial reading for all students and practitioners of juvenile and criminal justice.

As a pilgrimage centre of national importance, supported by the patronage of successive regional dynasties and by fervent popular belief, the Jagannatha Temple requires earthenware in great quantities for the creation and distribution of the sacred food that is an integral feature of daily ritual and pilgrimage. Three hundred potters participate as temple servants in maintaining the temple's ritual cycle by performing their divinely assigned task. This study, conducted in 1979-1981, observes the potters' technical prowess, sustained by devotion, but also examines the tensions within their relationships to more powerful temple servants and authorities. The role of the potter as temple servant is at once glorious, as demonstrated by texts and personal interpretations of the potters' divinely-appointed service, and pathetic, as shown in the brutality of caste-based hierarchy and cash-based exchange penetrating the modern temple's daily operations.

Book excerpt: Adolescence is a distinct, yet transient, period of development between childhood and adulthood characterized by increased experimentation and risk-taking, a tendency to discount long-term consequences, and heightened sensitivity to peers and other social influences. A key function of adolescence is developing an integrated sense of self, including individualization, separation from parents, and personal identity. Experimentation and novelty-seeking behavior, such as alcohol and drug use, unsafe sex, and reckless driving, are thought to serve a number of adaptive functions despite their risks. Research indicates that for most youth, the period of risky experimentation does not extend beyond adolescence, ceasing as identity becomes settled with maturity. Much adolescent involvement in criminal activity is part of the normal developmental process of identity formation and most adolescents will mature out of these tendencies. Evidence of significant changes in brain structure and function during adolescence strongly suggests that these cognitive tendencies characteristic of adolescents are associated with biological immaturity of the brain and with an imbalance among developing brain systems. This imbalance model implies dual systems: one involved in cognitive and behavioral control and one involved in socio-emotional processes. Accordingly adolescents lack mature capacity for self-regulations because the brain system that influences pleasure-seeking and emotional reactivity develops more rapidly than the brain system that supports self-control. This knowledge of adolescent development has underscored important differences between adults and adolescents with direct bearing on the design and operation of the justice system, raising doubts about the core assumptions driving the criminalization of juvenile justice policy in the late decades of the 20th century. It was in this context that the Office of Juvenile Justice and Delinquency Prevention (OJJDP) asked the National Research Council to convene a committee to conduct a study of juvenile justice reform. The goal of Reforming Juvenile Justice: A Developmental Approach was to review recent advances in behavioral and neuroscience research and draw out the implications of this knowledge for juvenile justice reform, to assess the new generation of reform activities occurring in the United States, and to assess the performance of OJJDP in carrying out its statutory mission as well as its potential role in supporting scientifically based reform efforts.
