Las variables estudiadas fueron el derecho a gozar de un ambiente equilibrado y el derecho fundamental. Los resultados permiten afirmar que la variable no llega a tener un alcance favorable en cuanto la protección del derecho fundamental a gozar de un ambiente sano y equilibrado. Se infiere entonces la necesidad de un precedente vinculante para una mayor protección y goce del indicado derecho.
