Book excerpt: En los últimos años se ha desarrollado un creciente movimiento económico impulsado por el auge del comercio electrónico y la utilización de las nuevas tecnologías, basado en la realización de transacciones económicas a través de plataformas virtuales y aplicaciones para dispositivos inteligentes (apps). Este fenómeno ha sido conceptualizado de muchas formas, si bien se le conoce comúnmente como "economía colaborativa", sharing economy o, quizá con más acierto, "economía de las plataformas virtuales", término este último que parece más adecuado debido a su neutralidad y porque pone énfasis en los entes protagonistas de esta realidad disruptiva. En la presente obra se analiza el origen, conceptualización y características de la economía de las plataformas virtuales, así como su relación con el Derecho internacional privado. En concreto, se analiza la competencia judicial internacional y la ley aplicable en el ámbito de la competencia desleal, teniendo en cuenta las particularidades derivadas de la economía de las plataformas virtuales. Aunque el estudio está enfocado desde el prisma de esta realidad disruptiva, no es menos cierto que las teorías expuestas y las conclusiones alcanzadas pueden aplicarse de forma general a los ilícitos desleales cometidos a distancia en el ámbito digital.

Book excerpt: La Ley 29/2009, de 30 de diciembre modificó la Ley de Competencia desleal del año 1991 para incorporar a ésta lo dispuesto en la Directiva de la Unión Europea relativa a las prácticas comerciales desleales de las empresas en sus relaciones con los consumidores. Las modificaciones introducidas en la Ley de Competencia Desleal son tan importantes que se considera que la Ley de Competencia desleal tiene un nuevo texto, aunque se conserven algunas normas del texto original del año 1991. Pues bien, la LCD en su nuevo texto plantea graves problemas interpretativos, puesto que la directiva es muy confusa y se basa en principios opuestos a los que respondía la Ley del año 1991. Estos comentarios tienen precisamente la finalidad de intentar aclarar cómo debe interpretarse el nuevo texto legal. A tal efecto se comentan los artículos de la LCD, como es habitual en esta clase de obras y esa tarea la han realizado profesores universitarios especialmente expertos en el estudio de la competencia desleal. La labor realizada en estos comentarios es especialmente importante por cuanto la Ley de Competencia Desleal del año 1991 ha tenido un gran éxito en su aplicación práctica y no cabe duda de que seguirán proliferando los litigios en que esa normativa es aplicable. Por ello estos comentarios interesarán, sin duda, tanto a los profesores universitarios, como, sobre todo, a los juristas prácticos, esto es, jueces y abogados.
