Book The Roles of Psychology in International Arbitration

Download or read book The Roles of Psychology in International Arbitration written by Tony Cole and published by Kluwer Law International B.V.. This book was released on 2017-03-15 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: The system of international arbitration is built on private contractual relations, yet has been endorsed by governments around the world as a fair and reliable alternative to litigation in State courts. As a private process, however, its authority and legitimacy derive entirely from the views and actions of those involved in the arbitral process, whether arbitrators, counsel, or parties. It is, though increasingly clear that psychological factors complicate, and in some cases radically change, every arbitral proceeding. In this context, psychological insights are crucial for understanding how international arbitration genuinely operates, and whether the legal framework currently applied to it is well-suited to achieving the aims of ensuring a fair and reliable dispute resolution procedure. This is the first book to focus on this important issue: the insights into international arbitration that can be gained from contemporary psychology. With contributions from nineteen internationally known figures in their fields – arbitrators, mediators, lawyers, law professors, psychology professors, psychologists – and drawing from a longer term project on the role of psychology in arbitration, this ground-breaking volume addresses a range of topics, including the following: - the decision-making processes of arbitrators; - the ability of arbitration to serve as a genuine dispute resolution mechanism; - the impact of particular procedures on the arbitral process; - bias, self-deception and vested interests in judgment and decision-making; - the role of arbitrators in managing the arbitral process; - cultural differences in the evaluation of arguments; - psychological influences on witness testimony; - the impact of tribunal composition on arbitral decision-making; - the influence of arbitration’s professional context on arbitrators and legal counsel; and - methods for arbitrators and legal counsel to more effectively manage the arbitral process. Informed by the behavioural insights in these essays, counsel and arbitrators will be enabled to think critically about the underlying assumptions and the potential behavioural effects of a prospective arbitration, while individuals researching arbitration will gain a greater understanding of the psychological context in which every arbitration occurs. This book meets the increasingly recognized need for understanding the role of psychology in arbitral proceedings, and forms an indispensable foundation for subsequent work in this area. Its innovative and forward-thinking analysis will be of immeasurable value to the international arbitration community, as well as to institutions supporting arbitration and to academics in the field.

Book Measuring Empowerment in Practice

Download or read book Measuring Empowerment in Practice written by Ruth Alsop and published by World Bank Publications. This book was released on 2012 with total page 123 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Alsop and Heinsohn present an analytic framework that can be used to measure and monitor empowerment processes and outcomes. The measuring empowerment framework, rooted in both conceptual discourse and measurement practice, illustrates how to gather data on empowerment and structure its analysis. The framework can be used to measure empowerment at both the intervention level and the country level, as a part of poverty or governance monitoring. The authors first provide a definition of empowerment and then explain how the concept can be reduced to measurable components. Empowerment is defined as a person's capacity to make effective choices--that is, the capacity to transform choices into desired actions and outcomes. The extent or degree to which a person is empowered is influenced by personal agency (the capacity to make purposive choice) and opportunity structure (the institutional context in which choice is made). Asset endowments are used as indicators of agency. These assets may be psychological, informational, organizational, material, social, financial, or human. Opportunity structure is measured by the presence and operation of formal and informal institutions, including the laws, regulatory frameworks, and norms governing behavior. Degrees of empowerment are measured by the existence of choice, the use of choice, and the achievement of choice. Following the conceptual discussion and the presentation of the analytic framework, the authors show how the measuring empowerment framework can be applied using examples from four development interventions. Each example discusses how the framework guided analysis and development of empowerment indicators. They also present a draft module for measuring empowerment at the country level. The module can be used alone or be integrated into country-level poverty or governance monitoring systems that seek to add an empowerment dimension to their analysis. This paper--a product of the Poverty Reduction Group, Poverty Reduction and Economic Management Network--is part of a larger effort in the network to conceptualize, operationalize, and measure empowerment"--Abstract.

Download or read book European Financial Regulation written by Veerle Colaert and published by Bloomsbury Publishing. This book was released on 2019-12-26 with total page 499 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mirroring the long-established structure of the financial industry, EU financial regulation as we know it today approaches banking, insurance and investment services separately and often divergently. In recent decades however, the clear separation between financial sectors has gradually evaporated, as business lines have converged across sectors and FinTech solutions have emerged which do not fit traditional sector boundaries. As the contours of the traditional tripartition in the financial industry have faded, the diverging regulatory and supervisory treatment of these sectors has become increasingly at odds with economic reality. This book brings together insights developed by distinguished researchers and industry professionals in a series of articles analysing the main areas of EU financial regulation from a cross-sectoral perspective. For each specific research theme – including prudential regulation, corporate governance and conduct of business rules – the similarities, as well as gaps, overlaps and unjustifiable differences between banking, securities and insurance regulation, are clearly presented and discussed. This innovative research approach is aimed at informing lawmakers and policymakers on potential improvements to EU financial regulation whilst also supporting legal and compliance professionals applying the current framework or looking to streamline compliance processes.

Book Argumentation

Download or read book Argumentation written by Frans H. van Eemeren and published by Routledge. This book was released on 2002-01-01 with total page 194 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book concentrates on argumentation as it emerges in ordinary discourse, whether the discourse is institutionalized or strictly informal. Crucial concepts from the theory of argumentation are systematically discussed and explained with the help of examples from real-life discourse and texts. The basic principles are explained that are instrumental in the analysis and evaluation of argumentative discourse. Methodical instruments are offered for identifying differences of opinion, analyzing and evaluating argumentation and presenting arguments in oral and written discourse. In addition, the book provides a great variety of exercises and assignments to improve the students' skill in presenting argumentation. The authors begin their treatment of argumentation theory at the same juncture where argumentation also starts in practice: The difference of opinion that occasions the evolvement of the argumentation. Each chapter begins with a short summary of the essentials and ends with a number of exercises that students can use to master the material. Argumentation is the first introductory textbook of this kind. It is intended as a general introduction for students who are interested in a proper conduct of argumentative discourse. Suggestions for further reading are made for each topic and several extra assignments are added to the exercises. Special features: * A concise and complete treatment of both the theoretical backgrounds and the practice of argumentation analysis and evaluation. * Crucial concepts from pragmatics (speech act theory, Grice's cooperative principle) presented in a non-technical way; introducing the theory of verbal communication. * Unique coverage of both oral and written presentation of arguments. * Exercises and assignments based on real-life texts from a variety of contexts.

Book Examining Argumentation in Context

Download or read book Examining Argumentation in Context written by Frans H. van Eemeren and published by John Benjamins Publishing. This book was released on 2009 with total page 317 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Examining Argumentation in Context: Fifteen studies on strategic maneuvering "contains a selection of papers on strategic maneuvering in argumentative discourse. Starting point of all of these contributions is that a satisfactory analysis and evaluation of strategic maneuvering is possible only if the argumentative discourse is first situated in the communicative and interactional context in which it occurs. While some of the contributions present general views with regard to strategic maneuvering, other contributions report on the results of empirical studies, examine strategic maneuvering in a particular legal or political context, or highlight the presentational design of strategic maneuvering. "Examining Argumentation in Context" therefore provides an insightful" "view of recent developments in the research on strategic maneuvering, which is currently prominent in the study of argumentation.

Available in PDF, EPUB and Kindle. Book excerpt: In this book two of the leading figures in argumentation theory present a view of argumentation as a means of resolving differences of opinion by testing the acceptability of the disputed positions. Book Knowledge in a Social World

Download or read book Knowledge in a Social World written by Alvin I. Goldman and published by Oxford University Press. This book was released on 1999-01-14 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: Knowledge in a Social World offers a philosophy for the information age. Alvin Goldman explores new frontiers by creating a thoroughgoing social epistemology, moving beyond the traditional focus on solitary knowers. Social, cultural, and technological changes present new challenges to our ways of knowing and understanding, and philosophy must face these challenges. Against the tides of postmodernism and social constructionism Goldman defends the integrity of truth and shows how to promote it by well-designed forms of social interaction. He urges that social discourse promises more than the mere politics of consensus, and that suitably norm-governed debate and belief-revision can increase veridical knowledge. Goldman's aims are not just philosophical but practical. From science to education, from law to democracy, he shows why and how public institutions should seek knowledge-enhancing practices. He examines how cyberspace and other technologies expand the scope of communication, and warns of the need to safeguard content quality. He scrutinizes the free marketplace of ideas, the adversary system in the law, and media coverage of political campaigns. The result is a bold, timely, and systematic treatment of the philosophical foundations of an information society.

Download or read book Social Epistemology written by Adrian Haddock and published by OUP Oxford. This book was released on 2010-11-04 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: The idea of approaching epistemological concerns from a social perspective is relatively new. For much of its history the epistemological enterprise -- and arguably philosophy more generally -- has been cast along egocentric lines. Where a non-egocentric approach has been taken, as in the recent work of naturalist epistemologists, the focus has been on individuals interacting with their environment rather than on the significance of social interaction for an understanding of thenature and value of knowledge. The fifteen new essays presented in this volume aim to show the fertility and variety of social epistemology and to set the agenda for future research. They examine not only the well-established topic of testimony, but also newer topics such as disagreement, comprehension, the norm of trust, epistemic value, and the epistemology of silence. Several contributors discuss metaphilosophical issues to do with the nature of social epistemology and what it can contribute to epistemology moregenerally. Social Epistemology will be essential reading for anyone interested in this fast-growing area of philosophy.
