Download or read book Health as a Human Right written by Octávio Luiz Motta Ferraz and published by Cambridge University Press. This book was released on 2020-12-17 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: Does human rights law work? This book engages in this heated debate through a detailed analysis of thirty years of the right to health - perhaps the most complex human right - in Brazil. Are Brazilians better off three decades after the enactment of the right to health in the 1988 Constitution? Has the flurry of litigation experienced in Brazil helped or harmed the majority of the population? This book offers an in-depth analysis of these complex and controversial questions grounded on a wealth of empirical data. The book covers the history of the recognition of health as a human right in the 1988 Constitution through the Sanitary Movement's campaign and the subsequent three decades of what Ferraz calls the politics and judicialization of health. It challenges positions of both optimists and sceptics of human rights law and will be of interest to those looking for a more nuanced analysis.
Download or read book Mediation in state courts written by Flávia Maria Aires Freire Allemão and published by Editora Dialética. This book was released on 2021-10-29 with total page 118 pages. Available in PDF, EPUB and Kindle. Book excerpt: The large caseloads to be tried in the courts and the dissatisfaction of jurisdictions with the judgments are the main reasons for the application of mediation in the courts. The culture of litigation and the Civil Law system applied in Brazil are driving factors in order to arise more lawsuits, given to a greater possibility of different decisions for similar situations, in contrast to the Common Law, applied in almost all of the United States, where the citizen is more cautious when filing lawsuits, because it is more difficult to reverse a precedent. Given the need to change this situation, a movement began in Brazil to encourage agreements between the parties in the process, with the National Council of Justice having issued the Resolution No. 125/2010 instituting mediation and, later, the provision of such institute by the new Code of Civil Procedure of 2015. The previous Code of Civil Procedure, from 1973, already regulated conciliation, although it does not have the same effectiveness as mediation in the resolution of conflicts in a more definitive way, especially in demands whose conflict parties have a continued relationship among themselves, such as those involving Family Law, for example. Indeed, among the different types of alternative methods of conflict resolution, mediation is within the best results. So, it is of fundamental importance the comparative study of the mediation in Brazil and the United States, analyzing the participants of mediation, the types of mediation, how it is applied in practice in each country, the advantages and disadvantages and thinking how to improve the institute of mediation in both countries, considering the differences and similarities between them.

Download or read book In the Maw of the Earth Monster written by James E. Brady and published by University of Texas Press. This book was released on 2013-04-01 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: As portals to the supernatural realm that creates and animates the universe, caves have always been held sacred by the peoples of Mesoamerica. From ancient times to the present, Mesoamericans have made pilgrimages to caves for ceremonies ranging from rituals of passage to petitions for rain and a plentiful harvest. So important were caves to the pre-Hispanic peoples that they are mentioned in Maya hieroglyphic writing and portrayed in the Central Mexican and Oaxacan pictorial codices. Many ancient settlements were located in proximity to caves. This volume gathers papers from twenty prominent Mesoamerican archaeologists, linguists, and ethnographers to present a state-of-the-art survey of ritual cave use in Mesoamerica from Pre-Columbian times to the present. Organized geographically, the book examines cave use in Central Mexico, Oaxaca, and the Maya region. Some reports present detailed site studies, while others offer new theoretical understandings of cave rituals. As a whole, the collection validates cave study as the cutting edge of scientific investigation of indigenous ritual and belief. It confirms that the indigenous religious system of Mesoamerica was and still is much more terrestrially focused that has been generally appreciated.
